On 10/11/24 Licensing Program Analyst (LPA) Mary Silva conducted an unannounced site inspection to present the findings of the above complaint allegations. Licensing staff met with licensee Linda Aguilera to whom the reason for the visit was explained. Licensee provided a tour of the facility. Present during the inspection was Licensee, Linda Aguilera and two children.

Licensee did not properly report incidents involving a daycare child.

During this investigation, LPA obtained a copy of the facility roster, reviewed file for child #1, obtained

LPA captured photographs of where the incident occurred. LPA conducted interviews with licensee, licensee’s assistant, and parents of children in care.

Regarding the allegation: Licensee did not provide adequate care and supervision to the daycare children. Licensee reported to department incident occurred on 08/15/24 in the living room. Per licensee child #1(C1) and Child #2(C2) were in the living room playing, while licensee was changing a diaper of a daycare child in the family room that’s adjustment to the living room. Licensee heard a loud scream from (C1). Licensee walked 5 steps through the doorway to enter the living room and observed (C1) with two abrasions one under the left eye and the other on his left check, broken skin was observed. Per licensee (C2) was removed from the living room to provide first aid to (C1). Per licensee three children were at the daycare on this day. No witnesses were present at the time.

Regarding the allegation: Licensee did not properly report incidents involving a daycare child. Licensee stated incident occurred in the afternoon and does not recall exact time. Parent of child #2 was notified immediately and parent of child #1 was informed of the incident during pick up time between 5:30pm-6:00pm.

Based on interviews and disclosures made during the department investigation, the preponderance of evidence and the standard has been met, therefore, the two allegations are found to be substantiated. California Code of Regulations (Title 22 Division & Chapter), are being cited on the attached deficiencies page LIC 9099-D. These incidents pose a potential risk to the Health and Safety of the children in care.

A notice of site visit was given and must remain posted for 30 days. Appeal Rights provided.
Failure to comply with posting requirements shall result in an immediate civil penalty of $100. Appeal rights were given.

Personal Rights Each child receiving services from a family child care home shall have certain rights that shall not be waived or abridged by the licensee regardless of consent or authorization from the child's authorized representative. These rights include but are not limited to, the following: (2) To receive safe, healthful, and comfortable accommodations, furnishings, and equipment. This requirement is not met as evidenced by:
Based on LPA’s interviews, staff confirmed that an incident took place in May of 2022, where child #4 was injured while in care. Staff providing care and supervision disclosed being present however, statements from the staff who observed child #4 when child #4 was injured were inconsistent and neither staff present saw the incident occur.

This poses a potential health and safety risk to children in care.

Licensee submitted a declaration stating children will be visually supervised at all times to ensure children are safe. Licensee will take preventative measures prior to an incident occuring. License will contact R&R to take a training on managing challenging behaviors.
