Based on LPAs observations and statements disclosed during interviews with Staff (S) S1, S2, S3, Child (C) C1, C2, C3 statements were made by C1 and S3 that S1 and S4 have had disputes in front of the children inside, outside and in the hallway. Other statements by S1's own submission that S4 will say something and its not a fact and we go back and forth. Another statement made by S1, Maybe raised voices, but not yelling at them, maybe a little bit, I am very loud. Other statement made by C1, children cry when S1 screams at them.
Pertaining to the allegation that "Staff member makes inappropriate comments to day care children"
Based on statements disclosed during interviews with S3 statements were made that S1 tells children to do their work again after they are done. Other statements disclosed by S3 were made that S1 tells children, don't do it again, didn't I tell you. Other statements disclosed during an interview with C1 were that S4 stated to children don't do baby stuff. Another statements disclosed by S2 own submission is that children are yelled at in a mostly authoritative way.
This agency has investigated the complaint alleging that "Staff member yells at (and in front of) day care children" “Daycare child sustained unexplained injuries while in care”.
Based upon the evidence as listed above, the preponderance of evidence standard has been met and the allegations have been determined to be Substantiated. A finding of Substantiated means that the preponderance of evidence standard has been met. California Code of Regulations, Title 22, Division 12, Chapter 1, Article 06, Section 101223 "Personal Rights" is being cited on the attached LIC 9099D.
LIC 9224 ACKNOWLEDGEMENT OF RECEIPT OF LICENSING REPORTS was provided.
A Notice of Site Visit was provided to Lead Teacher.
The Notice of Site Visit (LIC 9213) – must remain posted for 30 days during the hours of operation after each site visit by a licensing representative. Failure to maintain posting as required will result in a civil penalty of $100.00.
