32 | LPA Lee was able to confirm that some of the children were served the milk in the morning of 11/20/2023. There were a few staff members that tasted the milk themselves before serving it to the children. The staff members that tasted the milk did not believe the milk was spoiled. The milk in question were individual cartons and not a larger container. At some point after the children were served the milk, the milk was taken away from the students and discarded. There were no incidents of a child or children becoming ill from consuming the milk that was served on 11/20/2023 based on interviews conducted and records reviewed.
While it is possible that the milk that was served to children on the morning of 11/20/2023 was spoiled there was no way to confirm this since there is no way to establish how long the power was out between Friday 11/17/23 and Monday 11/20/2023. Some of the children did consume the milk before it was taken away by the staff and discarded. The staff members that physically carried the milk from the refrigerator to the classroom had tasted the milk before serving to the children. The reason the milk was served in the first place seems to have been caused by some sort of mix up between the staff physically present at the facility and staff members that were at a different physical location.
Based on the evidence collected during the investigation, the allegations that the facility staff served children in care expired milk may be valid. However, there is not a preponderance of evidence to prove the alleged violation(s) did or did not occur, therefore at this time the above allegation is found to be unsubstantiated.
The notice of site inspection must remain posted for a period of 30 days during hours of operation. Failure to maintain posting for 30 days will result in a civil penalty of $100.00 dollars.
