Licensing Program Analysts (LPAs) F. White and K. Dunlap arrived at the above location for the purpose of delivering findings of a complaint received to the department on July 10, 2024. LPA White announced the purpose of the visit and was granted entry into the facility by licensee, Cecilia Espinoza. There are 11 children enrolled. There are 9 children present at the time of inspection. All adults in the home have current background clearance.
During the course of this investigation, LPAs K. Dunlap and F. White conducted observations, reviewed records, and conducted interviews in an effort to deliver fair and truthful findings to the allegations of a Child sustained an injury while in care, and Licensee hit child in care. The information gathered from the interviews revealed that the licensee provides proper care for the children, there is clear communication from all staff, the children are engaged and growing fast. Interviews also revealed that the discplinary methods for the facility are redirection.

Review of facility documentation provided LPAs with the tools (Facility Roster) to conduct a fair and thorough investigation. Licensee provided full cooperation through the duration of the investigation.
When interviewing the licensee she states that she uses redirection as her method of handling children with behaviors. Licensee states that she and her staff have worked extensively with children who have behaviors and have therapist who provide care to children who require more attention. LPA White asked licensee has she ever hit a child in day care. Licensee states that she has never hit a child in day care, not even her own children. Licensee was asked how she communicates behavior matters to parents, and Licensee states that she speaks with the parents often whether during pick up, or a phone call if it's a serious matter.

During several observations LPAs observed children engaged in activities with special care being given to all the children. LPAs observed multiple children in different cognitive stages receiving care and clear direction during high energy activities. LPAs did not observe Licensee or staff abusing the personal rights of any of the children in care.

This Agency has investigated the above complaint and found that although the allegations may have happened or is valid; based on observations and interviews there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore at this time the allegations are deemed UNSUBSTANTIATED.

The facility was found in compliance per Title 22 regulations, there will be no deficiencies cited today, 08/22/2024.
A notice of site visit was given and must remain posted for 30 days.
The report was reviewed with the Licensee, Cecilia Espinoza. A copy of the report and appeal rights was given to Licensee Cecilia Espinoza.
