Licensing Program Analyst (LPA) Lilli Babcock conducted an unannounced complaint inspection to deliver findings for the above allegations. A COVID risk assessment was conducted. LPA met with Director, Maricruz Flores, to whom the reason for the visit was explained. Director guided LPA on a tour of the facility. LPA observed fifty-one (51) children and five (5) staff present at the facility during this inspection.
During this investigation LPA conducted interviews with Director, four (4) staff, three (3) children, and eight (8) day care parents. LPA also obtained several documents related to the complaint allegations, including but not limited to, a copy of the Facility Roster (LIC 9040), Family Handbook for facility, and Personnel Report (LIC 500).

Complaint alleges staff allowed a child to remain in soiled and wet clothing while in care. Staff interviewed stated parents provide a change of clothing in case of need and are not aware of a time when a child was allowed to remain in soiled clothing. LPA observed the facility Family Handbook states parents are to, “provide two complete sets of extra clothes, including socks…and an extra pair of shoes”. LPA observed extra sets of clothes in the children’s cubbies in the preschool classrooms. Parents interviewed did not disclose any issues with their children being in soiled clothing. Children interviewed stated they have never sat in wet clothes. Child #1 stated. “If we pee on ourselves we just change our clothes right away”.

Allegation #2: Staff did not ensure a daycare child’s napping equipment was properly maintained

Complaint alleges a child’s blanket used for napping was wet inside the child’s cubby. Staff interviewed stated a wet blanket has not been used by children for napping, and that after the nap the staff checks the bedding to make sure it is clean and dry before placing it in the cubbies after naptime. Staff #2 stated on one occasion a "parent brought wipies and it was in the cubby and then it got the bedding wet and I noticed when I took the bedding out and switched it out for clean bedding". Parents interviewed did not disclose an issue with their child’s blankets used for napping. Per Director, the bedding is washed every week by the facility. LPA inspected the bedding during visits and did not observe any of the bedding to be damp or wet. Children interviewed stated their blanket at naptime is never wet.

Allegation #3: Staff are operating beyond the terms and conditions of the license

Complaint alleges the facility is operating beyond the terms and conditions of the license and at times are combining classes with the infant program. Staff interviewed stated they do not combine the preschool and infant classes at any time. Parents interviewed did not disclose the facility being out of ratio or combining classes with the infant program. Children interviewed stated their classrooms have never been combined with the infant classes.

Based on the information gathered, and interviews conducted, although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are unsubstantiated.

There were no deficiencies cited on the above-mentioned allegations per California Code of Regulations Title 22.

A notice of site visit was given and must remain posted for 30 days.
Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
