On March 21, 2023 at 11:30 AM, Licensing Program Analyst (LPA) Monique Ayala conducted an unannounced case management inspection at the facility and met with Director, Annette Covel. The purpose of the inspection was to inform the facility that a lead testing exceedance was reported to the Department. There were 23 children and 6 personnel present during this inspection.

LPA reviewed Assembly Bill (AB) 2370, Chapter 676, Statues of 2018, which requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010 to test their drinking water for lead contamination between January 1, 2020 and January 1, 2023, and then every 5 years after the date of the first test.

A copy of the report that covers the analysis performed on samples submitted to Home Biotesting on February 15, 2023 was provided to LPA. The Department received notification from the State Water Resources Control Board (SWRCB), Division of Drinking Water (DDW) that the facility was inspected and samples were collected on February 17, 2023. The following sample was found to contain 5 ppb or greater lead content:
    1. Kindergarten Room Sink Faucet - 5.72 ppm.

Per facility representative, the facility does not use any water outlets or faucets for consumption or food preparation. Facility representative stated that children bring their own water from home and water bottles are available. Facility representative also stated that snacks and meals are brought from the children's home each day which went into place since the facility reopened after the COVID-19 pandemic. Per facility representative, the facility contacts parents/guardians in the event a child forgets to bring their snacks or meal for the day.

At 12:32 PM, LPA took a photograph of the Kindergarten Room Sink Faucet. LPA observed bottled waters available for the children inside the classroom. LPA also observed a children's restroom located inside the classroom that had two (2) other sinks available for hand-washing.

During the inspection, the facility representative posted "Water not to be used for Consumption" sign at the problem fixture and shut-off the water to the Kindergarten Room Sink Faucet. Per facility representative, the facility will reach out to their water system for guidance and will provide awareness to personnel.

LPA provided a copy of the Lead Poisoning Facts Flyer (PUB 515), Provider Information Notice (PIN) 22-06-CCP, and Lead Testing in Child Care Centers Frequently Asked Questions (FAQs).
