32 | On 02/07/25, LPA Eivazian watched facility video footage with staff#3 in the facility. LPA and staff #3 observed on video footage that child#1 walked out of preschool middle gate at 4:18:34 PM, alone, while child#1 wore a red sweater and had a yellow picacho toy in hand, walked all the way alone on school age yard. At 4:21:17 PM child#1 observed to pass the school age second gate towards the school age enclosed big grass yard. At 4:22:25 PM staff#3 observed to find child#1 right after school age enclosed court yard gate.
On 02/20/25, LPA Eivazian counted approximately 86 footsteps from preschool middle gate to where the child#1 was found on 01/31/25 by staff#3. Pictures were taken.
Based on LPA’s observations and interviews which were conducted with four staff, child#1 was unsupervised and wondered away at school age enclosed yard alone on 01/31/25 from 4:18:34 PM to 4:22:25 PM.
Based on LPA observations and interviews which were conducted and record reviews, the preponderance of evidence standard has been meet, therefore the above allegation is found to be Substantiated at this time. California Code of Regulations, 101229(a) (1)-- Responsibility for Providing Care and Supervision--(a)The licensee shall provide care and supervision as necessary to meet the children's needs. (1) No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation is being cited on the attached LIC9099D.
LPA Anomeh Eivazian informed Site Supervisor, Perla Leyvas that this report dated 02/20/25 documents 1 Type A citation. Type A citation which shall be posted for 30 consecutive days as there is immediate risk(s) to the health, safety, or personal rights of children in care.
Also, LPA Eivazian informed the licensee to provide a copy of this licensing report dated 02/20/25 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.
The notice of site visit was posted where the parent/guardian of children enter and exit the facility. This notice shall remain posted for 30 consecutive days. Failure to maintain posting as required will result in a $100.00 civil penalty.
