32 | on the carpet and watched the activity that was going on at that time in the auditorium. Per staff#7, child#1 was unsupervised from the time that children were lined to come back to the preschool classroom and child#1 was found while still children were on school age middle enclosed yard.
Based on an interview that was conducted with complainant, child#1 was found unsupervised in auditorium by staff #7 on 11/14/24, when Rams visited the school.
LPA counted approximately 50 foot steps from where staff#7 found out child#1 was missing, it was between school age middle enclosed yard between the middle tree and gate toward the grass yard, and where child#1 was found inside the auditorium on the carpet. Pictures were taken.
Based on LPA observations and interviews which were conducted and record reviews, the preponderance of evidence standard has been met, therefore the above allegations are found to be Substantiated at this time. California Code of Regulations, 101229(a) (1)-- Responsibility for Providing Care and Supervision--(a)The licensee shall provide care and supervision as necessary to meet the children's needs. (1) No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation and 101223(a)(2) is being cited on the attached LIC9099D.
LPA Anomeh Eivazian informed Site Supervisor, Perla Leyvas that this report dated 02/28/25 documents 1 Type A citation. Type A citation which shall be posted for 30 consecutive days as there is immediate risk(s) to the health, safety, or personal rights of children in care.
Also, LPA Eivazian informed the licensee to provide a copy of this licensing report dated 02/28/25 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.
The notice of site visit was posted where the parent/guardian of children enter and exit the facility. This notice shall remain posted for 30 consecutive days. Failure to maintain posting as required will result in a $100.00 civil penalty.
