Licensing Program Analyst (LPA) Judy Mora conducted an unannounced site inspection on this date to conclude the investigation for the above complaint allegations. LPA met with Veronica Rafael, Interim Site Supervisor. LPA was guided on a tour of the facility at approximately 10:43 AM.

At the time of this inspection, LPA Mora observed nine children with one staff in the Toddler 2 Room and 16 children with two staff from the Preschool Room on the outdoor playground.

During the course of this investigation interviews were conducted with staff. LPA also obtained and reviewed copies of childrens sign in and out sheets for February and March of 2023. LPA obtained and reviewed copies of staff timecards for February and March of 2023.

During the review of staff and children time sheets, it was observed that on February 24, 2023 at approximately 9:52 AM there were 14 children present in the Preschool classroom with one teacher and on March 15, 2023 at approximately 10:00 AM there were 14 children present in the Preschool classroom with one teacher; these instances placed the facility out of ratio.

On March 15, 2023, a staff member placed a shelf in front of an exit door in an attempt to prevent children from leaving the classroom. Disclosures were made by staff confirming this incident. This was a immediate risk to the health and safety of children in care.

Based on the available information, the preponderance of evidence standard has been met, therefore the above allegation(s) are found to be Substantiated. California Code of Regulations,(Title 22, Division 12 & Chapter Number 1), are being cited on the attached LIC. 9099D.

These deficiencies pose an immediate Health and Safety risk to clients in care.

Upon receipt of this report, the licensee shall post ANY licensing report documenting a type “A” citation. This must remain posted for 30 days during hours of operation. In addition to posting this report, the licensee will also provide copies to the parents of the children in care for up to one year.

A copy of the LIC 9224 - Acknowledgement of Receipt of Licensing Reports was provided.

Exit interview was conducted with Veronica Rafael. Appeal rights were provided.

Teacher-Child Ratio
There shall be a ratio of one teacher visually observing and supervising no more than 12 children in attendance, except as specified in (b) and (c) below.
This requirement was not met as evidenced by record review.

Interim Director states she will make sure that the facility is in ratio at all times. They are hiring an additional teacher that is set to start on May 1, 2023.

Building and Grounds
All outdoor and indoor passageways, stairways, inclines, ramps, open porches and other areas of potential hazard shall be kept free of obstruction.
This requirement was not met as evidenced by staff disclosures.

Interim Director states that shelves will not be placed in front of doorways. The facility plans to reccomend to the building that door alarms will be placed on the doors. Written statement will be sent to LPA by 04/17/23.
Failure to correct the cited deficiency(ies), on or before the Plan of Correction (POC) due date, may result in a civil penalty assessment.
