25 | Licensing Program Analyst (LPA) Judy Mora conducted a case management inspection due to incidents that occurred on 07/13/22 (Incident #1) and 07/29/22 (Incident #2). LPA met with Teacher Rocio Urias, who guided LPA on a tour of the facility. Director, Miranda Valdescona and Assistant Director, America Torres, arrived during this inspection.
Incident #1 occurred on Wednesday, July 13 and the facility became aware of the incident on 07/15/22; this incident was reported to the Department on Friday, 08/05/22, via phone. Incident #2 occurred on 07/29/22 and was reported to the Department on 08/05/22 via phone. The facility was required to report both incidents to the Department within 24 hours and failed to do so. The facility is being cited for not meeting this requirement as it is a potential risk to the health and safety of children in care.
LPA conducted interviews and obtained documentation during this inspection.
(Incident #1) On 07/13/22, a parent observed Staff #1 spray a child with a spray bottle on his head while he was crying, the child rubbed his head and started crying more. Parent observed Staff #1 walk away from the child while he was crying. The incident was reported by the parent to administration on 07/15/22. Based on the information provided during this visit, it was found that staff #1 violated child #1's personal rights. Each child shall be accorded the personal right: To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature. This was an immediate risk to the health and safety of children in care.
