Licensing Program Analyst (LPA) Staicy Perry conducted an unannounced Case Management inspection. Upon arrival LPA met with Director Felicia Sanchez. Director guided LPA on a tour of the facility. The purpose of the inspection is to follow up on an Unusual Incident reported to the regional office. Census was taken. LPA observed 25 children and 3 staff at the time of inspection. This is a preschool program and hours of operation are M-F 6:45am-6:00pm. A COVID-19 risk assessment was conducted prior to entering the facility. There is an infant license on the same premises, license number 198008723.

The department received an incident report via email from this facility on 03/18/2024 for an incident that occurred at the facility on 03/15/2024 involving an incident of a child who wondered away from the daycare center premises. Center Director notified LPA via Voicemail on 3/16/2024 at 8:48am (Saturday), out of normal business hours of the department.

Brief summary of incident: Child #1 (C1) walked away from the facility unsupervised. On Friday, March 15, 2024 at approximately 9:55am Center Director relieved S#3 on the Preschool play yard to take (3) children to the restroom. During this time a child opened the emergency gate and walked into the court yard of the Center. Around 10:00am S1 on the Toddler play yard notified Center Director that the C1 had gone through the gate. The Center staff was unaware that the gate was replaced and no alarm sounded.

During the inspection LPA conducted (3) staff interviews regarding the incident. LPA obtained documentation in the form of Facility Roster via email, Personnel Roaster, photos, measurements, parent handbook, Employee handbook sign in and out sheets, video footage and a copy of the report from the guard’s officer statement.

During the visit LPA Perry observed the Emergency Exit door located in the preschool play yard on the right-hand side of the play yard, which leads to the main courtyard that is public access as well as street access to Temple Street. LPA did not observe the Emergency Door to be labeled with a sign indicating its an Emergency Exit door. The Emergency door is the only Emergency door in the preschool play yard. LPA opened door several times to see the accessibility of the door. Door is light weight with a very faint sound when you push the door open which was just put on 3/15/24 after the incident occurred. Per video footage obtained from the Federal Police Service child #1 was seen to go to the Emergency Door with C#2. C#1 was seen to open the door and shut the door. C#1 and C#2 were seen to be playing on the gate running alongside the gate. C#1 was outside of the facility in the courtyard that is public access. C#2 was seen inside of the gate. LPA observed the child to be outside of the facility for 1 minute and 13 seconds before she was assisted by S#2. S#2 was not positioned where she can maintain supervision of the children. S#2 was seen to be positioned near the canopy on the preschool play yard near the grass area where she cannot see the Emergency Gate from where she was standing. Two staff were present in the outside area. S#1 was inside of the Infant play yard at the time of the incident. S#2 was inside the preschool play yard. Based on interviews with both staff present neither were positioned close enough to attend to C#1 while child one was existing the preschool play yard emergency door, which resulted in C#1 wondering off the facility. Neither staff seen the child exit the emergency door.

Based on observations and information obtained during interviews conducted with four (3) staff,(1) Video footage and photos of the incident, LPA Perry determined that on March 15, 2024, in the Preschool play yard where C#1 wondered away from the daycare center premises. Based on interviews with both staff present neither were positioned to maintain 100% supervision to prevent C#1 from wondering off the day care premises. Nor were neither staff close enough to attend to C#1 while C#1 wondered off, which resulted in C#1 exiting the facility. C#1 was measured to have been 2 inches away from the premises (outside in the courtyard).

LPA has determined that their was a lack of care and supervision that occurred when a child managed to wonder off the day care site, unnoticed which poses an immediate risk to the health and safety to the child in care.

Based on LPAs observations, video footage, security guard report investigation and interviews which were conducted and record reviews, the preponderance of evidence standard has been meet, therefore the above incident that occurred on 3/15/2024, C#1 wondered away from facility is found to be Substantiated at this time. California Code of Regulations, 101229(a) (1)-- Responsibility for Providing Care and Supervision--(a)The licensee shall provide care and supervision as necessary to meet the children's needs. (1) No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation and 101223(a)(2)-- (a) The licensee shall ensure that each child is accorded the following personal rights: (2) To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs are being cited on the attached LIC9099D.



LPA Staicy Perry informed Director that this report dated 3/19/24 documents 2 of Type A citations. Type A citations which shall be posted for 30 consecutive days as there is immediate risks to the health, safety, or personal rights of children in care.

Also, LPA Staicy Perry informed Director to provide a copy of this licensing report dated 3/19/24 that documents 2 Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. The Acknowledgement form must be maintained in each child’s file immediately upon receipt from parent. Director was provided with a copy of the parent Acknowledgement of Receipt of Licensing Reports Form during this visit. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

The Notice of Site Visit (LIC 9213) was given and must remain posted for 30 days.

Based on staff interviews and video footage, child#1 was found outside the facility by S#1 in the courtyarf of the facility which has public access. Staff did not see how child#1 wonder off the premises. This poses an immediate health, safety and personal right risk to the children in care.
