32 | During the interview with the Licensee, it was disclosed that the Licensee and her husband went on vacation and were out of town during period 10/3/23 - 10/13/23 and during their absence, there were two uncleared adults (Staff 1 and Staff 2) working at the facility and providing care and supervision to children in care. There were 2 children attending the program while Licensee was away for 11 days. The facility was open and operating regular hours.
During the interview of Staff 1, it was disclosed that they worked at the facility during the absence of the Licensee.
Parents interviewed stated that during drop off and pick up, they observed two staff members (Staff 1 and Staff 2) working at the facility and providing care and supervision to children in care.
Statements obtained during the course of this investigation were consistent and corroborated with the allegation listed on this complaint.
Based on LPA’s observations and interviews which were conducted and record reviews, the preponderance of evidence standard has been met, therefore the above allegation is found to be Substantiated. California Code of Regulations, (Title 22, Division & Chapter number), are being cited on the attached LIC 9099D. A finding that the complaint is substantiated means that the allegation is valid because the preponderance of the evidence standard has been met.
The Notice of Site Visit was provided and must remain posted for 30 days during the hours of operation after each site visit by a licensing representative. Failure to maintain posting as required will result in a civil penalty of $100.00. Exit interview was conducted with Teresita Bitanga and Appeals Rights provided.
**In addition; A copy of this report must be provided to the authorized representatives of all currently enrolled children and any newly enrolled child for the following 12 months.
The ACKNOWLEDGEMENT OF RECEIPT OF LICENSING REPORTS (LIC9224) shall be signed and kept in each of the children’s records. The report shall be provided no later than the next business day or the next day the child is in care. |
