grabbed child 1’s face because Child 1 was crying and they attempted to get Child 1's attention, calm them down, and wipe the tears from their face. Interview with Staff 2 confirmed Staff 1’s statement. Staff 2 stated that Staff 1 grabbed Child 1’s face gently. Based on interviews the allegation is not supported.
It was alleged that staff speaks inappropriately to day care children. RP stated Staff 1 yelled at Child 1. LPA interviewed staff and during visits observed staff interacting with children. Interviews with staff revealed that staff do not speak to day care children inappropriately. Staff 2 observed the incident that occurred on 09/23/2024 with Staff 1 and Child 1. Staff 2 stated that Staff 1 is soft spoken and is not loud. During visits, LPA observed that staff members were engaging with students in an appropriate and respectful manner. Based on interviews and observation the allegation is not supported.
Pertaining to the allegation that due to lack of supervision, child received an injury. RP stated that after Staff 1 grabbed Child 1’s jaw, Child 1 had a scratch on their face that they suspected was caused by Staff 1. LPA interviewed staff, children, and parents and reviewed photos. Staff 1 stated that they watch Child 1 attempt to pull down Child 2 from climbing apparatus. Per Staff 1, that is when they picked Child 1 up from off the climbing apparatus and Child 1 started to cry. Shortly after Staff 1 grabbed Child 1’s face. At the time, Staff 1, stated that they did not notice a scratch on Child 1’s face. LPA reviewed photos and examined Staff 1’s hands. Upon review, it was observed that Staff 1’s hands have short nails. Based on this observation and interviews, the suspicion that due to lack of supervision, child received an injury is not supported.
Based on interviews, observation, documentation obtained, the allegations that staff handled day care child in a rough manner, staff speaks inappropriately to day care children, and due to lack of supervision, child received an injury are unsubstantiated. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove that the alleged violation occurred, and the findings are unsubstantiated.
An exit interview was conducted with Director, Kim Sung Mee. The Notice of Site Visit was given and must remain posted for 30 days. |
