On November 15, 2024, at 12:00pm Licensing Program Analyst (LPA) A. Carter conducted an Unannounced Annual Random inspection and met with licensee Cynthia Ruiz and two (2) assistants. LPA disclosed the purpose of the inspection and was granted entry into the facility.
All adults associated to the home were found to have criminal record clearance. There were three (3) daycare children present during today’s inspection. Licensee states that there are currently ten (10) children enrolled. The children's roster was reviewed and is current. This facility provides care to children ages 6months to 13 years old. Licensee reports that the facility’s hours of operation are Monday thru Friday from 6:00am to 6:00pm. Licensee does not provide overnight care but does provide afterschool transportation.
The Parent Board had the following required documents posted:

The Disaster Drill log was current with the last drill conducted on April 15, 2024. Licensee was advised disaster drills shall be conducted every 6 months. All life saving devices such as Carbon Monoxide Detector, Smoke Detector, and Fire Extinguisher were observed by LPA. Dual Carbon Monoxide and Smoke Detectors located in the main care area and enclosed patio were tested and operable at the time of inspection. The 2A10BC Fire extinguisher was fully charged with last service date of June 6, 2024.
This is a two story home which consists of five (5) bedrooms, three (3) bathrooms, kitchen / laundry area, dining room, living room, enclosed patio, attached garage, front and back yard with pool. LPA did not observe a fireplace in the home. Areas used by the children include the enclosed patio (main daycare area) restroom inside daycare area, living room, dining room, restroom in the hallway, and front yard. Per Licensee, areas off-limits to children include kitchen / laundry area, four (4) bedrooms downstairs, and one (1) bedroom and one (1) bathroom upstairs, and entire backyard. LPA observed that there is a baby gate separating areas used by children and off-limits area. Per licensee, off limit areas are also locked during operating hours, LPA observed doors to be locked making them inaccessible to children in care.

All areas identified on the facility sketch as accessible to children were inspected to ensure that they are clean and orderly with ventilation and heating for the safety and comfort of the children in care. There is a working telephone maintained in the home via landline / cellphone. The isolation area for sick children waiting to be picked is in the living room, supervised away from the other children in care. LPA observed toys and other age appropriate materials available for children to use in the main care area free of loose and sharp parts. Per licensee, food is provided for children in care. LPA reminded licensee that any food brought from the children’s homes shall be labeled with child’s name and properly stored or refrigerated. Sharp objects, detergents and cleaning compounds were inaccessible to children in care. Knives are kept in an upper kitchen cabinet, cleaning products are in a latched cabinet under the sink, detergent is in the off-limits laundry area. Medication is stored in an upper kitchen cabinet. Per Licensee, no children enrolled require medication. The kitchen has a safety gate installed to prevent access making it inaccessible to children in care. The licensee states that there are no poisons in the home. The Licensee does understand that poison must be locked. The Licensee was advised that inaccessibility of hazards must be constantly reassessed depending on the children in care.

Per licensee, the children will have access to the front yard for outside play. LPA observed age appropriate toys such as playhouse, play structure with slides and rock climbing, toddler size basketball court, tricycles, and toddler size cars. LPA observed front yard has grass and adequate perimeter fencing through-out the yard and all trees, shrubs, and plants are maintained.
There is a pool in the off-limits backyard of the home. The pool is fully fenced with a padlock. There is also an alarm on the gate that sounds when the gate is opened. There is a door that leads to the backyard in the daycare room, it is locked during operating hours.
Infant Care: Currently licensee has two (2) infants enrolled. Per Licensee infants use play yards for napping observed by LPA. Napping equipment does not block entrances or exits. Licensee was advised Infants shall not be swaddled in care. Car seats shall not be used for sleeping. LPA discussed the new Safe sleep regulation, including LIC 9227 Infant Sleep Plan for infants under 12 months, 15-minute sleep check documentation for infants 0-24 months.
Children’s records were reviewed for (LIC) 282- Affidavit Regarding Liability Insurance, Immunization's Records, LIC 700- Identification and Emergency Information, LIC 627- Consent for Medical Treatment, LIC 995A Notification of Parents’ Rights, and documentation of 15-minute Infant Sleep Check (0-24 months). All required licensing forms are on file.

Staff records were reviewed: Licensee's and assistants Pediatric First Aid / CPR expires on 8/3/26. Staff had proof of required immunization's. All adults had proof of TB clearance. Licensee's and assistants Mandated Reporter training was completed in 07/14/23. All adults had LIC 508 criminal record statement, and LIC 9052 on file.

During the inspection, children present was observed to be treated with dignity and respect, observed to be receiving safe, healthful, and comfortable accommodations, furnishings, and equipment, and free from corporal and/or unusual punishment.

Licensee stated that there are no smokers in the home.

Licensee stated there is one (1) small dog in the home observed by LPA at time of inspection.

Licensee stated there are no weapons, or firearms in the home.

Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee [or facility representative] of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02-CCP. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. Licensee was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to childcare providers and Resource and Referral Agencies (R&Rs) throughout California.

During the exit interview, the LICENSEE Cynthia Ruiz, confirmed that there are no Registered Sex Offenders living in the facility and LPA completed the RSO profile in FAS.

The facility was found in compliance per Title 22 regulations, there will be no deficiencies cited today.

A notice of site visit was given and must remain posted for 30 days.

Exit interview conducted and report was reviewed with the licensee Cynthia Ruiz.
