An office meeting was held today with Elizabeth Estrada, Licensee, and Karina Garcia, Facility Director to review the facility's history, discuss substantial compliance with licensing laws and regulations, and provide the licensee with available resources.

The following deficiency history was reviewed: Personal Rights, Supervision, Teacher/Child Ratio, Capacity Determination, and Reporting Requirements.

Personal Rights 101223 - The licensee shall ensure that each child is accorded the following personal rights: To be accorded dignity in his/her personal relationships with staff and other persons and to be accorded safe, healthful, and comfortable accommodations, furnishings, and equipment to meet his/her needs.


· On November 29, 2023, a staff interview and records review disclosed that diapers are not changed timely.
· On November 20, 2023, a staff posted a video of children on social media.
· On November 16, 2023, staff & children interviews disclosed staff yell and speak inappropriately to children.

Criminal Record Clearance 101170 - All individuals subject to a criminal record review pursuant to Health and Safety Code Section 1596.871 shall Obtain a California clearance or a criminal record exemption prior to working, residing, or volunteering in a licensed facility. On March 30, 2023, there was one staff present with no criminal record clearance.

Responsibility for Providing Care and Supervision 101229 - The licensee shall provide care and supervision as necessary to meet a child's needs. No child shall be left without the supervision of a teacher at any time. Supervision shall include visual observation. On November 30, 2023, LPA observed that staff were not able to supervise children when they changed diapers due to a blind spot. This a duplicate deficiency that was also cited on May 16, 2023.

Teacher-Child Ratio 101216.3(a) - There shall be a ratio of one teacher visually observing and supervising no more than 12 children in attendance. On May 16, 2023, based on LPA observation, staff interviews, and record review, 3 of 7 staff were supervising children alone without teacher qualifications.
Limitations on Capacity 101161 - A licensee shall not operate a child care center beyond the conditions and limitations specified on the license, including the capacity limitation. On August 17, 2021, based on interviews and record review it was determined that three children in care are school-age and attend the day care part-time for afternoon sessions after their elementary school day ends.
Sign In and Sign Out 101229.1 – The person who brings the child to, and removes the child from, the center shall sign the child in/out. On May 16, 2023, staff interviews and review of sign-in/out sheets disclosed that staff have signed children in and out of the facility.

Corrective and preventative measures in place to ensure compliance were discussed. Licensee will submit any documents requested below by 8/28/24:
  • Facility will conduct monthly meetings with all staff and review children's personal rights in the meeting and send the meeting summary signed by all staff to LPA
  • Licensee will propose a few ideas for maintaining supervision while diapering in the Care Bears room
  • Licensee will support Director in maintaining staff and children's files.
  • Licensee will review the Personal Rights video and submit a plan for how the facility will ensure children's personal rights will not be violated
  • Licensee will ensure parents are signing children in and out of the facility using full signatures
  • Licensee will pay current overdue fees and ensure that annual fees are paid promptly
  • Licensee will send past staff meeting agendas for the last 6 months to LPA by 8/28/24.

TSP was offered to the Licensee and Licensee stated she would like to participate. LPA provided additional resources to the licensee on the department’s website. The licensee was also advised of the following:
1. The department will conduct more frequent inspections to ensure compliance.
2. It is the licensee's responsibility to understand and comply with Title 22 Regulations at all times.
3. The licensee was advised to attend local licensing calls and to sign up for provider information notices and quarterly updates.

The licensee was informed that failure to correct deficiencies by the agreed-upon due dates and to maintain compliance could lead to a Non-Compliance Conference. An exit interview was conducted with the licensee, who agreed with the topics discussed during today's meeting.
