32 | Allegation #1: Staff yell at children
During interviews, two children interviewed stated they have heard staff yelling at a child in care. Child #1 (C1) stated staff yell “Clean up or you’re going to waste your time and we are not going outside". C1 stated they feel nervous when staff yell at the children. Child #3 (C3) stated staff yell at children when “people be bad at sleepy time” and when staff yell at children, C3 stated it makes them feel “embarrassed and it makes me not want to come to school”. Staff #3 (S3) also disclosed they have heard staff yell at children in care.
Allegation #2: Staff speak inappropriately to children
During interviews, Child #1 stated when they asked staff to warm up their lunch, staff stated “Jesus Christ” and this occurred “everyday”. C1 stated this makes them feel nervous. Staff #5 (S5) corroborated this during their interview. S5 stated, a child “was being insistent about warming up (their) food, and I said “Jesus Christ, I can’t do it right now. You need to hold on until someone leaves the room and then I can do it for you”. During the interview, S5 stated “I can see how maybe that is not a good thing to say. Maybe I should have worded it differently”.
Based on interviews conducted by LPA Babcock, the preponderance of evidence standard has been met, therefore the above allegations are found to be SUBSTANTIATED. California Code of Regulations, (Title 22, Division 12 & chapter 1), are being cited on the attached LIC 9099D.
A notice of site visit was given and must remain posted for 30 days.
Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
