Licensing Program Analyst (LPA) Lilli Babcock conducted an unannounced complaint inspection to deliver findings for the above allegations. LPA met with Director, Karina Garcia to whom the reason for the visit was explained. LPA went on a tour of the facility to obtain the census. LPA observed twenty (20) children and three (3) staff were present at the facility during this inspection.

During this investigation, LPA conducted interviews with three (3) staff including Director, four (4) day care children, and eight (8) day care parents. LPA Babcock also obtained documents related to the complaint allegation, including but not limited to, a copy of the Facility Roster (LIC 9040), and Personnel Report (LIC 500).

Allegation #1: Staff yell at children

During interviews, two children interviewed stated they have heard staff yelling at a child in care. Child #1 (C1) stated staff yell “Clean up or you’re going to waste your time and we are not going outside". C1 stated they feel nervous when staff yell at the children. Child #3 (C3) stated staff yell at children when “people be bad at sleepy time” and when staff yell at children, C3 stated when staff yell at children it makes them feel “embarrassed and it makes me not want to come to school”. Staff #3 (S3) also disclosed they have heard staff yell at children in care.

Allegation #2: Staff shared videos of children on public social media account

During interviews, Staff #1 (S1) disclosed that they have posted a video on a public social media platform which showed the faces of children in care. LPA Babcock reviewed the video posted by S1 and observed faces of children on the video. S1 confirmed the video was recorded in the facility classroom and the children in the video were children in care.

Based on interviews conducted and records reviewed by LPA Babcock, the preponderance of evidence standard has been met, therefore the above allegations are found to be SUBSTANTIATED. California Code of Regulations, (Title 22, Division 12, & Chapter 1), are being cited on the attached LIC 9099D. No citation was issued on this day for Allegation #1 as a citation was issued for the same allegation on 11/17/23 under complaint number 33-CC-20231003092021.

A notice of site visit was given and must remain posted for 30 days.
Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

An exit interview conducted, and the report was reviewed with Director, Karina Garcia.

Director states all staff will watch the personal rights video on the CCLD Childcare Website. Director will have all staff sign that they viewed and understand the video and children's personal rights. Director will have staff sign a declaration stating they will not post children's faces on public forums.
