Licensing Program Analyst (LPA) Lilli Babcock conducted an unannounced follow-up complaint inspection to deliver findings on the above allegations. A COVID risk assessment was conducted. LPA met with Director, Karina Garcia, to whom the reason for the visit was explained. Upon arrival, LPA observed 18 children and 3 staff present on the outdoor play area.

During this investigation LPA conducted interviews with Director, three (3) staff and nine (9) day care parents. LPA Babcock also obtained several documents related to the complaint allegations, including but not limited to, a copy of the Facility Roster (LIC 9040), Personnel Report (LIC 500), and copies of employee timecards and sign-in/sign-out sheets for all children in care for the time period of 10/9/23-10/31/23.

Allegation #1: Staff do not provide adequate supervision of children in care

According to the allegation, the Care Bears classroom has doors and walls that obstruct the view to the restroom so 2 staff are needed when assisting children with diapering or toileting to maintain visual supervision of all children in care. The complaint alleges additional staff during diapering or toileting is not always received and staff alone in the Care Bears classroom are not able to maintain visual supervision of all children when assisting children with diapering or toileting. LPA observed that it is not possible with the current classroom arrangement to change a child’s diaper and see the entire classroom unobstructed. During interviews with staff, when asked if they have ever had to change a child’s diaper while being the only staff present in the 2-year-old room, Staff #1 stated “Yes…It has only been a few times”. Staff #1 stated the last time this occurred was “Maybe 3 or 4 weeks ago, because (2 staff) were both out that day”. This is a repeat violation from a citation issued on 5/16/23.


Allegation #2: The facility toilet is in disrepair.

According to the allegation, one of the toilets in the 2-year-old classroom (Care Bears) has not worked since September of 2023. LPA observed during a visit to the facility on 11/8/23 that one of the two toilets in the Care Bears room (the toilet furthest from the classroom) was not in working order and the toilet bowl was stained or dirty with brown vertical markings around the inside of the toilet bowl. The lid to the toilet was observed to be closed, however no signage was observed by LPA signaling the toilet did not work. Pictures were taken of the inside of the toilet. LPA attempted to flush the toilet, but it did not flush. During interviews, Director confirmed the toilet was not operational and stated, “Ya it doesn't flush” and that the toilet had not been operational for “maybe just a few weeks”. The facility is licensed for a capacity of 54 children. Title 22 Regulation 101239(h) states “Based on the total licensed capacity, one toilet and one handwashing fixture shall be maintained for every 15 children, or fraction thereof”. Therefore, the facility capacity of 54 children will require 4 maintained and functional toilets at the facility. LPA observed 2 functional toilets between the

Teddy Bear and Panda Bear classrooms and only 1 functional toilet in the Care Bears classroom, which totals 3 functional toilets and does not meet the regulation. During the visit on 11/29/23, LPA observed the toilet had been repaired in the Care Bear classroom, however the toilet closest to the classroom does not flush. Director stated she would notify the owner of the facility and have the toilet repaired.

Based on observations, records reviewed, and interviews conducted by LPA, the preponderance of evidence standard has been met, therefore the above allegations are found to be SUBSTANTIATED. California Code of Regulations, (Title 22, Division 12 & chapter 1), are being cited on the attached LIC 9099D.

A notice of site visit was given and must remain posted for 30 days.
Failure to comply with posting requirements shall result in an immediate civil penalty of
$100.

According to the allegation, all 3 classrooms are combined in the afternoon in the Panda Bears classroom and often there is only one teacher providing care for all the remaining children that have not been picked up, and the facility is often out of ratio. LPA obtained and reviewed copies of employee timecards and sign-in/sign-out sheets for all children in care for the time period of 10/9/23-11/3/23. After the review it appears the facility had adequate staffing available to be in ratio from 10/9/23-10/31/23. Staff interviewed did not disclose being out of ratio. Parents interviewed did not report concerns regarding facility being out of ratio.

Based on LPAs interviews with staff, and parents, although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is unsubstantiated.

There were no deficiencies cited on the above-mentioned allegation per California Code of Regulations Title 22.

A notice of site visit was given and must remain posted for 30 days.
