Licensing Program Analyst (LPA) Lilli Babcock conducted an unannounced follow-up complaint inspection to deliver findings on the above allegations. A COVID risk assessment was conducted. LPA met with Director, Karina Garcia, to whom the reason for the visit was explained. Director guided LPA on a tour of the facility. LPA observed nine (9) children with two (2) staff present in the Care Bears classroom, and twelve (12) children with one (1) staff present in the Panda/Teddy Bear Classroom.

During this investigation LPA conducted interviews with Director, five (5) staff, three (3) children, and four (4) day care parents. LPA Babcock also obtained several documents related to complaint allegation, including but not limited to, a copy of the Facility Roster (LIC 9040), Personnel Report (LIC 500), and Ouch Reports for Child #1.

Allegation #1: Staff did not provide adequate supervision resulting in day care child sustaining multiple injuries.

According to the allegation, Child #1 has received a large number of Ouch Reports during the last few months from the facility for injuries received while at the center. LPA obtained two Ouch Reports from the file of Child #1 dated 7/15/24 and 9/16/24. During interviews staff stated they have not been out of ratio and have maintained constant visual supervision of children at all times. Staff stated they always provide an Ouch Report to parents for injuries received at the facility. Parents interviewed stated they are happy with the care and supervision of their children.

Allegation #2: Staff spoke to day care children in an inappropriate manner.

Complaint alleges staff were observed yelling at children to get off the playset, and a staff member was observed yelling while taking a personal phone call. All parents interviewed stated they are happy with the care and supervision of their children and did not disclose they have heard staff yelling at or in front of children. Staff interviewed stated they do not take personal phone calls while caring for children and do not yell at children in care. Children interviewed did not disclose staff yell at children in care or take phone calls while caring for children.

Based on interviews conducted and information gathered, there was no evidence to support the allegations. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore at this time the above allegations are unsubstantiated.

There were no deficiencies cited on the above-mentioned allegations per California Code of Regulations Title 22.

A notice of site visit was given and must remain posted for 30 days.
Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
