An unannounced inspection was conducted by Licensing Program Analyst (LPA) Roxana Lopez on 1/16/2025. An attempted visit was conducted on 1/9/2025. The purpose of this inspection is to provide the findings of the complaint investigation which was received on 11/25/2024. LPA met with Gabby Dominguez, Director to whom the purpose of the inspection was announced. Census was taken.

Throughout the course of the investigation, interviews were conducted with staff, child # 1 and parents. LPA also reviewed and obtained copies of children’s rosters, personnel reports and other documentation.
Per initial complaint report, the complainant reported that Child # 1 exited the playground due to inadequate supervision, as Child # 1 pushed open a door that lead to parking lot.

In regards to allegation # 1 Child left the classroom without being noticed due to inadequate supervision. LPA conducted interviews with staff # 1- 5.

All staff statements corroborated the child # 1 pushed the emergency door open and ran out, however incident was observed by staff. Per Staff # 4, they were standing by the playground structure when they heard a child who was on the climbing tree stump informed child # 1 that they saw their parent- Staff # 4 then observed child # 1 pushing the emergency door and running out to their authorized representative which was entering the main door of facility. Staff # 4 stated that they yelled out to stop and ran after child- when they reached the door child # 1 was already with authorize representative. Per Staff # 5 they were by the end of the structure as they were walking to take a child to the bathroom- as Staff # 4 yelled out that Child # 1 had ran out- Per Staff # 5 they observed Staff # 4 run after child # 1.

Staff # 4 & # 5 corroborated that the alarm on emergency door did not go off when door was pushed open. On 11/24/2024 LPA Lopez observed that the alarm on door was not operating. Per Staff # 1 the alarm on emergency door is now operating- and they have a key to turn off alarm if door is open. LPA Lopez observed the alarm operating on 1/16/2025.

LPA conducted interviews with parents. Parent’s statements corroborate that they do not have any concerns with supervision in the playground and that they like the care that their child receives.

LPA conducted interview with Child # 1 who disclosed that they did run out the door and that staff # 4 told them to stop and “followed” them. Per Child # 1 they ran out because they wanted to go with their authorize representative.

This agency has investigated the complaint alleging child left the classroom without being noticed due to inadequate supervision. Based upon the evidence as presented above, the allegation has been determined to be Unsubstantiated. A finding of Unsubstantiated means that although the allegation may have happened or is valid, there is not a preponderance of evidence to prove alleged violation(s) did or did not occur, therefore at this time the above allegation is unsubstantiated.

A notice of site visit was given and must remain posted for 30 days. Exit interview conducted and report was reviewed with Director Gabby Dominguez.
