32 | Based on an interview that was conducted with staff#1, on 01/20/26, while child#1, had hard time and was putting a bucket on head, staff#1 tried to prevent child#1 to put the bucket on head to cover face, while staff#1 was assisting child#1, child#1 pulled back, and accidentally staff#1 scratched child#1 on the arm and nail red mark was left on the child#1’s arm which did not happen intentionally. Per staff#1, child#1’s parents were informed and report was given and signed by parents.
Based on interviews that were conducted with staff#1 and staff#2, child#1 was bitten by child#2 when child#1 grabbed child#2's crayon from hand and child#2 bit child#1. Per staff#1, staff#2, and child#2's therapist, child#2 bite if someone grab something from child#2’s hand. On 01/27/26, at the time of the incident child#2’s therapist went to the bathroom, staff#1 was in the classroom had her back to the children's table while staff#1 was talking to another teacher, staff#2, was assisting another child, at that time staff#1 and staff#2 heard child#1 cried out and noticed child#2 bit child#1. Per staff#1, a report was sent out to child#1’s parents’ same day. Per staff#1 and staff#2, both were present in the classroom and heard child#1 cried out when child#2 bit child#1, but they did not see the incident.
Based on LPA observations and interviews which were conducted and record reviews, the preponderance of evidence standard has been meet, therefore the above allegations are found to be Substantiated at this time. Title 22 Regulation code 101223(a)(2)--Personal Rights--(a)The licensee shall ensure that each child is accorded the following personal rights: (2) To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs and 101229 (a)-Responsibility for Providing Care and Supervision: The licensee shall provide care and supervision as necessary to meet the children's needs are being cited on the attached LIC 9099D.
The following deficiencies listed on the attached LIC 809 (deficiency page) are being cited in accordance with California Code of Regulations Title 22. Deficiencies that are being cited need to be cleared to protect the children’s health & safety.
The Notice of Site Visit (LIC 9213) was given and must remain posted for 30 days.
