On 09/26/2023 at 11:01AM, Licensing Program Analyst (LPA) Thelma Razo and Kruz Long conducted an unannounced Case Management inspection for an Action Level Exceedance (ALE) detected in a water fixture in the facility. A COVID 19 risk assessment was conducted prior to entering the facility. LPA met with facility representative Alma Campos during the visit. Also present in the facility 19 day care children, 4 teachers and 2 assistants. Facility was within ratio & capacity. Facility representative Navid Aguilar arrived later during this inspection.

Analyst reviewed new Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, which requires the testing of water for lead in Child Care Centers (CCCs) with facility Director during the inspection. Per AB 2370, all CCCs that are in buildings constructed before January 1, 2010, must have their water tested and post the results by January 1, 2023, and every 5 years after the date of the first testing.

Facility sketch and required forms LIC 9275, LIC9276 and LIC999 was received by the Department on 9/14/2023.

The State Water Resources Control Board (SWRCB) report indicated the facility was inspected and samples were collected. Faucets and drinking fountain reported with 5.5 ppb or greater lead exceedance levels were as follows:

  • Drinking Fountain- A (100 UG/L) – LPA observed drinking fountain was removed - picture was taken.
  • Drinking Fountain- C (15 UG/L) – LPA observed drinking fountain was removed - picture was taken.

Staff stated that the facility has not been using the drinking fountain since the pandemic in 2020. Facility uses tap water from the kitchen area.

A deficiency was cited under California Code of Regulation Title 22. See LIC809D.

A notice of site visit was also provided and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

During this inspection, LPAs observed that the two drinking fountain were capped and removed. Deficiency was cleared today.

This requirement is not me at evidenced by Based on inspection, the licensee did not comply with the directive above. The drinking fountain A and C tested with an Action Level Exceedance (ALE) of 100UG/L and 15 UG/L respectively. This poses a potential health and safety risk to children in care.
