Licensing Program Analyst (LPA) Monica Ruiz conducted an unannounced annual inspection. LPA met with licensee, Lety Mancias, and her assistant, who guided analyst on a tour of the facility. There were 8 children present, 2 infants, during this inspection. Licensee states that there are currently 10 children enrolled.

Family members residing in the home are 3 adults (criminal record clearances on file).

This is a one-story home which consists of main day care room, 4 bedrooms (1 bedroom is used for napping children), 3 bathrooms, kitchen, living room, and front and back yard(fenced). The children use the restroom in the main day care room and the bedroom next to the main day care room. Per licensee, areas off limits to children and parents include: 3 bedrooms, 2 bathrooms, living room, kitchen, back yard and front yard. The LPA toured all areas used by children during this visit. LPA observed a child gate in place to make the off-limits portion of the house inaccessible to children in care.

FACILITY EVALUATION REPORT California law requires a public report of each licensing visit/inspection. This report is a record for the facility and the licensing agency. This report is available for public review; therefore, care is taken not to disclose personal or confidential information. Inquiries concerning the location, maintenance, and contents of these reports may be directed to the Licensing Program Analyst or Regional Office whose address and telephone number are listed on the front of this form.

DEFICIENCIES A deficiency is an instance of noncompliance with licensing requirements, including applicable statutes, regulations, interim licensing standards, operating standards, and written directives. Applicants/ licensees must be notified in writing of all licensing deficiencies. Deficiencies are listed on the left side of this form, and the applicable licensing requirement upon which the deficiency is identified. There are two types of deficiencies:
  • Type A deficiencies are violations of licensing requirements that, if not corrected, have a direct and immediate risk to the health, safety, or personal rights of persons in care.
  • Type B deficiencies are violations of licensing requirements that, without correction, could become a risk to the health, safety, or personal rights of persons in care, a recordkeeping violation that could impact the care of said persons and/or protection of their resources, or a violation that could impact those services required to meet the needs of persons in care.

PLANS OF CORRECTION (POCs) The licensing agency is required to establish a reasonable length of time to correct a deficiency. In order to set the time, the licensing agency must take into consideration the seriousness of the violation, the number of persons in care involved, and the availability of equipment and personnel necessary to correct the violation. Applicants/licensees are requested to provide a specific plan for each violation on the right side of the form across from each deficiency. The more specific the plan, the less chance exists for any misunderstanding in setting time limits and reviewing corrections. The applicant/licensee who encounters problems beyond their control in completing the corrections within the specified time frame may request and may be granted an extension of the correction due date by the licensing agency.

CORRECTION NOTIFICATION The applicant/licensee is responsible for completing all corrections and promptly notifying the licensing agency of corrections. Applicants/licensees are advised to keep a dated copy of any correspondence sent to the licensing agency concerning corrections, or if corrections are telephoned to the licensing agency, the date, person contacted, and information given.

CIVIL PENALTIES The licensing agency is required by law to issue a Penalty Notice, when applicable, to all facilities holding a license issued by the licensing agency, or subject to licensure, except Certified Family Homes, Resource Families, and Foster Family Homes, or any governmental entity.

PENALTY NOTICE GIVEN The statement concerning civil penalties serves as a penalty notice on this Licensing Report and failure to correct cited licensing deficiencies will result in civil penalties. Applicants/ licensees are required to pay civil penalties when administrative appeals have been exhausted and in accordance with any payment arrangements made with the licensing agency.

APPEAL RIGHTS The applicant/licensee has a right without prejudice to discuss any disagreement in this report with the licensing agency concerning the proper application of licensing requirements. The applicant/ licensee may request a formal review by the licensing agency to amend or dismiss the notice of deficiency and/ or civil penalty. Requests for review shall be made in writing within 15 business days of receipt of a deficiency notification or civil penalty assessment. Licensing deficiencies may be appealed pursuant to the procedures in the LIC 9058 Applicant/Licensee Rights.

AGENCY REVIEW The licensing agency review of an appeal may be conducted based upon information provided in writing by the applicant/licensee. The applicant/licensee may request an office meeting to provide additional information. The applicant/licensee will be notified in writing of the results of the agency review within 60 business days of the date when all necessary information has been provided to the licensing agency.

EMAIL REQUIREMENT Adult Community Care Facilities, Residential Care Facilities for the Chronically Ill, and Residential Care Facilities for the Elderly are required to provide and maintain an active email address of record with the licensing agency.

During this tour, the following was noted: Eight children present were napping at the time of my arrival. Six children were observed to be sleeping on mats in the day care room and two infants were sleeping, each in their own crib, in the nap room. At 1:30 p.m., LPA was toured through the interior of the home. Areas accessible to children were inspected to ensure that they are clean and orderly with ventilation and central heating for safety and comfort. In the day care room there were safe toys, play equipment and materials observed for children such as dolls, puzzles, action figures, books and art supplies. There are 2 high chairs available for children to use while eating and a long table with chairs for children to sit at while they eat. LPA observed mats available for children to use during nap time. LPA did not observe any hazards inside of the home. There is a working telephone service maintained in the home. Detergents, cleaning compounds, medications, and other items which can pose a danger to children are stored in the inaccessible portion of the house. The licensee states that there are no poisons in the home. The licensee does understand that poison must be locked with a key or combination lock.
Licensee states she provides breakfast lunch and snack for children in care. One infant's mother provides breast milk for the child in care. Breast milk is labelled with child's name.

LPA observed and inspected sleeping equipment for infants. LPA observed four play yards in the day care room, for each infant who is unable to climb out of the play yard. There is 1 crib and one play pen in the napping room. All equipment meets the US Consumer Product Safety Commission safety standards. LPA observed that play yards are free from loose articles and objects. There are no objects hanging above or attached to the side of the play yard. LPA observed that play yards do not hinder the entrance or exit to and from the space they are sleeping in. Mattresses were observed to be firm and covered with a fitted sheet that is appropriate to the mattress size. Each infant has their individual bedding and is washed weekly as required. Soiled bedding is replaced when wet or soiled and is placed in an area inaccessible to infants. Licensee was advised that infants shall not be swaddled while in care and all infants up to 12 months should be placed on their back for sleeping.

LIC 9227 (Individual Sleeping Plan) for infants up to 12 months and Title 22 Regulation Section 102425(j) Infant Safe Sleep was reviewed and discussed with the Licensee, including but not limited to documentation that shall be maintained.

Per licensee, there are no weapons, firearms or bodies of water on the premises. Children’s records were reviewed and observed to be complete. LPA issued the Confidential Names List (LIC 811) to the Licensee during this inspection. The LIC 859 and the LIC 857 documents the staff names recorded and children’s files that were reviewed during this inspection. The valve on the required 2A 10BC fire extinguisher indicates fully charged with a service tag dated 05/24/2024. At 2:15 pm., Smoke detector and carbon monoxide detector in the entrance way were tested and are in operable condition. The licensee has current Pediatric First Aid and CPR, which will expire 03/2026.

Incidental Medical Services (IMS) policy was discussed. Per Licensee there are currently no children enrolled who required IMS. For IMS information see Evaluator Manual - Regulation Interpretations and Procedures for Family Child Care Homes Section 102417. AB1207 Mandated Child Abuse Reporting – On or before March 30, 2018, any person who works in a child care facility shall complete the training and renew the training every 2 years. Website provided: https://www.mandatedreporterca.com/training/child-care-providers

The following was discussed:

·Individuals who are 18 years of age or older living in the home must obtain a criminal record clearance. Individuals within one month of their 18th birthday must be fingerprinted immediately. Failure to obtain a criminal record background check clearances prior to initial presence in the home will result in an immediate $100.00 dollar or more per day Civil Penalty.

·The Licensee shall be present in the home and shall ensure that children are supervised at all times.

·Children shall not be left in park vehicles.

·The capacity specified on the license shall be the maximum number of children for whom care can be provided.

·Car seats shall only be used for transportation purposes and shall not be used for sleeping.

·All children in care have the right to receive safe, healthful, and comfortable accommodations, furnishings and equipment.

·When child shows sign off illness, they will be separated from other children until the nature if the illness is determined.

At this time, there were no deficiencies cited during today’s inspection.

A notice of site visit was given and must remain posted for 30 days.
