32 | LPA called complainant to obtain further details on the allegations made. Complainant refused to answer any questions and or provide any details regarding allegations. Complainant did not want child #1 and child #2 to be interviewed.
LPAs conducted interviews with licensee. Per licensee, she drinks occasionally after hours or during the weekend when she does not have any children present. Licensee guided LPAs to where alcohol is kept. LPAs observed sealed alcohol bottles to be in the kitchen area in a hutch, on the top shelf locked via a child safety lock. Licensee advised LPAs that all medications are stored in the off-limit bedroom. LPAs observed the bedroom to be locked during the inspection.
LPAs conducted interviews with parents and children. Parents statements corroborated that they have not witnessed any unusual behavior from licensee, and they are happy with the care and supervision that their children receive. Children's interviews corroborated that they like their school and the licensee. No disclosures were made regarding the allegations.
LPAs did not observe any alcohol and/ or any other hazardous materials in any other accessible areas in the home. LPAs advised licensee to keep in mind her tallest child when storing items and when storing any hazardous materials to be kept off limits and not made accessible tot the children. LPAs reviewed with licensee Personal Rights LIC 613A and advised licensee to follow these rights for the health and safety of the children.
This agency has investigated the complaint alleging, licensee is under the influence of alcohol while in the presence of day care children and licensee does not prevent day care children from having access to hazardous materials while in care. Based upon the evidence presented above the allegations have been determined to be unsubstantiated. A finding of Unsubstantiated means that although the allegation may have happened or is valid, there is not a preponderance of evidence to prove alleged violation (s) did or did not occur, therefore at this time the above allegation is unsubstantiated.
A Notice of Site Visit was provided and must be posted for 30 days.
Exit interview was conducted and report was reviewed with Licensee, Rosa Carranza.
