On 05/21/2026 at approximately 8:55am, Licensing Program Analyst (LPA) Jonnisha Culbert conducted an unannounced annual/random inspection at the facility noted above. LPA met with licensee, Esperanza Barreto, explained the purpose of today's visit, and provided them with an Entrance Checklist-family Child Care Homes (LIC 126). Licensee guided LPA on a tour of the facility. Individuals residing in the home were discussed and noted. The operating hours of the facility are Monday through Friday from 7:00 AM to 6:00 PM. The licensee and one child were present upon arrival.

At approximately 9:30am, a second child arrived with Adult 1 (A1) and Adult 2 (A2).

This is a single-family home that consists of three bedrooms, two bathrooms, a living room, den, kitchen, attached garage, and enclosed backyard.

Areas that are accessible to children include: one bathroom, one bedroom, living room, den, kitchen, and fenced backyard. LPA observed that the off-limits areas of the home were not made inaccessible to children. Licensee was reminded that all off limits areas of the home are to be made inaccessible to children.
 
Areas off-limits to children include: two bedrooms, one bathroom, and attached garage..

The following documents were posted: Facility License, Notification of Parents' Rights (PUB 394), and Emergency Disaster Plan (LIC 610A). LPA did not observe Earthquake Preparedness form.

FACILITY EVALUATION REPORT California law requires a public report of each licensing visit/inspection. This report is a record for the facility and the licensing agency. This report is available for public review; therefore, care is taken not to disclose personal or confidential information. Inquiries concerning the location, maintenance, and contents of these reports may be directed to the Licensing Program Analyst or Regional Office whose address and telephone number are listed on the front of this form.

DEFICIENCIES A deficiency is an instance of noncompliance with licensing requirements, including applicable statutes, regulations, interim licensing standards, operating standards, and written directives. Applicants/ licensees must be notified in writing of all licensing deficiencies. Deficiencies are listed on the left side of this form, and the applicable licensing requirement upon which the deficiency is identified. There are two types of deficiencies:
  • Type A deficiencies are violations of licensing requirements that, if not corrected, have a direct and immediate risk to the health, safety, or personal rights of persons in care.
  • Type B deficiencies are violations of licensing requirements that, without correction, could become a risk to the health, safety, or personal rights of persons in care, a recordkeeping violation that could impact the care of said persons and/or protection of their resources, or a violation that could impact those services required to meet the needs of persons in care.

PLANS OF CORRECTION (POCs) The licensing agency is required to establish a reasonable length of time to correct a deficiency. In order to set the time, the licensing agency must take into consideration the seriousness of the violation, the number of persons in care involved, and the availability of equipment and personnel necessary to correct the violation. Applicants/licensees are requested to provide a specific plan for each violation on the right side of the form across from each deficiency. The more specific the plan, the less chance exists for any misunderstanding in setting time limits and reviewing corrections. The applicant/licensee who encounters problems beyond their control in completing the corrections within the specified time frame may request and may be granted an extension of the correction due date by the licensing agency.

CORRECTION NOTIFICATION The applicant/licensee is responsible for completing all corrections and promptly notifying the licensing agency of corrections. Applicants/licensees are advised to keep a dated copy of any correspondence sent to the licensing agency concerning corrections, or if corrections are telephoned to the licensing agency, the date, person contacted, and information given.

CIVIL PENALTIES The licensing agency is required by law to issue a Penalty Notice, when applicable, to all facilities holding a license issued by the licensing agency, or subject to licensure, except Certified Family Homes, Resource Families, and Foster Family Homes, or any governmental entity.

PENALTY NOTICE GIVEN The statement concerning civil penalties serves as a penalty notice on this Licensing Report and failure to correct cited licensing deficiencies will result in civil penalties. Applicants/ licensees are required to pay civil penalties when administrative appeals have been exhausted and in accordance with any payment arrangements made with the licensing agency.

APPEAL RIGHTS The applicant/licensee has a right without prejudice to discuss any disagreement in this report with the licensing agency concerning the proper application of licensing requirements. The applicant/ licensee may request a formal review by the licensing agency to amend or dismiss the notice of deficiency and/ or civil penalty. Requests for review shall be made in writing within 15 business days of receipt of a deficiency notification or civil penalty assessment. Licensing deficiencies may be appealed pursuant to the procedures in the LIC 9058 Applicant/Licensee Rights.

AGENCY REVIEW The licensing agency review of an appeal may be conducted based upon information provided in writing by the applicant/licensee. The applicant/licensee may request an office meeting to provide additional information. The applicant/licensee will be notified in writing of the results of the agency review within 60 business days of the date when all necessary information has been provided to the licensing agency.

EMAIL REQUIREMENT Adult Community Care Facilities, Residential Care Facilities for the Chronically Ill, and Residential Care Facilities for the Elderly are required to provide and maintain an active email address of record with the licensing agency.

LPA observed water collected inside of fountain in the on limits outdoor area and a small running fountain in the front yard along path children use to enter the home. Per record review, License was cited for accessible fountain running and filled with water on 04/19/2024. This poses an immediate health, safety or personal rights risk to persons in care.

At approximately 9:22am, while touring the on limits outdoor play area, LPA observed a fountain. The water was not running, however there was water collected inside of the fountain with insects swimming in it. Prior to LPA observing the water fountain in the backyard, LPA observed a small running fountain in the front yard along the path that children use to enter the home. This is an immediate health, safety, and personal rights risk to persons in care. LPA reminded the licensee that the fountains are to remain empty while children are in care.
 
Areas used by children were inspected for safety, comfort, heating, cleanliness, and telephone service. LPA observed age-appropriate toys and furniture (indoor and outdoor), mats, play yards, and highchairs. Per Licensee, the home is equipped with central heating and air. Sharp objects, cleaning compounds, and medicines were not made accessible to children. At approximately 9:28am, LPA observed scissors and a lighter inside of an accessible drawer in the on limits kitchen. At approximately 9:29am, LPA observed medication inside an accessible pantry. Per licensee, the child safety device on the pantry is hard to open, so they leave the device off to access items inside of the pantry.   One minute later, LPA observed lysol spray sitting on top of the toilet tank in the accessible bathroom. This is a potential health, safety, or personal rights risk to persons in care. Per licensee, the children are too little to use the restroom on their own, so they assist the children in the restroom. LPA reminded licensee that hazardous items such as scissors, lighters, and lysol spray should remain in an area that is inaccessible to children. Per Licensee, poisons are kept in the garage. LPA reminded licensee that poisons are to remain in areas that are locked and inaccessible to children. Per licensee, there are no firearms on the premises.

At approximately 9:56am, LPA observed a play yard with an attached bassinet and toy bars.  Inside the bassinet, there was a baby lounger and a blanket. Per licensee, the mattress is too hard. LPA reminded licensee of safe sleep regulations and provided them with provider information notification (PIN) 20-24-CCP Safe Sleep.

LPA checked the home for required emergency devices. LPA observed a fire extinguisher (3-A:10-B:C) that is fully charged and last serviced on 08/25/2025. Licensee was reminded to purchase or service the fire extinguisher yearly. Carbon monoxide detector and smoke alarm were observed and are operable. The

disaster drill log was not available. This is a potential health, safety, and personal rights risk to persons in care.

Due to time restraint, LPA informed the licensee that the annual/random will be completed on a later date. On that date, the following will be addressed:
-Mandated reporter training
-use of highchair
-Infant sleep log
-Assistant
-Off limits area of the home

LPA Jonnisha Culbert informed licensee, Esperanza Barreto that this report dated 05/21/2026 documents one Type A citation which shall be posted for 30 consecutive days as there is immediate risk to the health, safety, or personal rights of children in care.

Also, LPA Jonnisha Culbert informed the licensee, Esperanza Barreto to provide a copy of this licensing report dated 05/21/2026 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt Licensing Report (LIC 9224), or other written statement, must be placed in the child’s file for verification.

One Type A and four type b citations were cited during today's visit. Please see LIC 809s.
Notice of site visit and appeal rights were given. The notice of site visit must remain posted for 30 days.
