Licensing Program Analyst (LPA) R. Derraco conducted an unannounced complaint inspection to the above mentioned facility on 08/20/24. LPA began this inspection at 11:00 AM and was met by Director of Education, Edwina Shivers, who guided analyst on a tour of the facility. LPA observed 38 children in care and 9 adults caring for the children. The facility's phsycial plant was observed to be in compliance with California Code of Regulation (CCR) Title 22 regulations.

The purpose of this visit is to deliver complaint findings to the above mentioned allegations. During the investigation, LPA conducted interviews, reviewed records, and made observations. Individuals interviewed confirm that another child's parents accessed a classroom, began using vulgar language, and threatened C1 by instructing C2 to bite C1. During an interview, S1 confirms that S2 was preventing C2 and her parents from biting C1. S1 states she was attending to the other children in the classroom while S2 was attending to C1. Individuals interviewed stated they felt there was no danger at the time that C2's parent arrived at the facility when they confronted S2 and C1. using vulgar language in front of all children present in the classroom. LPA observed a video confirming vulgar language being used by the parents and verbal instructions being given to C2 to bite C1. Individuals interviewed state that they informed the Director of the incident by telephone, but did not inform the parents. Based on LPAs observations, interviews conducted, and record review, the preponderance of evidence standard has been met, therefore the above allegations are found to be SUBSTANTIATED. California Code of Regulations Chapter 1 Article 6 Section 101223(a)(3) and Section 101212(f), are being cited on the attached LIC 9099D. LPA advised Director that a type A citation will be issued under Section 101223(a)(3)(personal rights) and a type B citation will be issued under Section 101212(f)(reporting requirements).

LPA R. Derraco informed Director Edwina Shivers that this report dated 08/20/24 documents one Type A citation which shall be posted for 30 consecutive days as there is/are immediate risk(s) to the health, safety, or personal rights of children in care.

Also, LPA R. Derraco informed the Director to provide a copy of this licensing report dated 08/20/24 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

Notice of site visit was given and must remain posted for 30 days.
