At 2:25 pm Licensing Program Analyst (LPA) Roxana Lopez conducted an unannounced required 1 year inspection to the above facility. A risk assessment was conducted upon entry- appropriate PPE was used. LPA met with Fernando Recendez assistant who guided analysts on a tour of the facility. Clara Recendez, Licensee arrived at 2:35 pm and took over the inspection. Per Licensee, 15 children are currently enrolled. A current children’s roster was available for review. There were 6 children present upon arrival. 1 being an infant. Also present during the inspection was Licensee’s 2 son’s (assistants) and 1 assistant. Upon arrival LPA observed Staff # 5 bringing child out of a bedroom in the front of the house. Per assistant, child was being changed. LPA inspected room and advised Licensee, that if that room is used for sleeping- appropriate sleeping arrangements should be in the room.

The licensee states that 5 adults currently live in the home. Per Licensee, they currently have 4 assistants. All adults present in the home have obtained a criminal record clearance or exemption prior to working, residing or volunteering in the licensed childcare home. Licensee states that there are no firearms stored in the home.

This is a one-story home which consists of 4 bedrooms, 2.5 restrooms, living room, dining room, kitchen, den, garage front and backyard (fenced). The children have access to den, 2 bedrooms (one located by the den and the other in the front part of the house, ½ bathroom and backyard.

Per licensee, areas off limits to children and parents include: 3 bedrooms, 2 bathrooms, living room, dining room and kitchen (used as walk through only). -------------- pg.1 of 5 --------------------------------

The LPA toured all areas used by children during this visit. LPA observed a baby gate between den and dining room making the front of the house inaccessible to children in care.

All areas identified on the facility sketch that are accessible for children to use were inspected for safety, comfort, and cleanliness. There is telephone service via a cellphone that stays at the facility during operation hours. There is ventilation and heating (central). The following was observed and reviewed during this inspection.

Detergents, cleaning compounds, and medications were observed to be inaccessible to children. Poisons are locked under key in the off-limits garage. The restroom that children use was observed to be safe and sanitary.

LPA Lopez did observed a fireplace in the off limits living room which was barricaded and inaccessible for children in care. The valve on the required 2A 10BC fire extinguisher indicates fully charged and was serviced on 3/29/2023, as indicated on service tag. Smoke and carbon monoxide detectors were tested and are operable. All homes shall conduct fire and disaster drills at least once every six months, and document the date and time of each drill. Last drill documented was conducted on 4/4/2023.

Emergency Disaster Plan, Parent’s Rights Poster and the Facility License were observed to be posted in the den area.

There are toys available for children. Appropriate sleeping arrangements in form of cots, crib and playpens were observed.

Licensee states that they are currently caring for infants. LPA also informed licensee Clara Recendez of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

At 3:25 pm LPA observed that Licensee did not have sleep documentation for child # 1 on file. LPA provided a sample sleep log to Licensee on this date.

LPA Lopez advised Licensee and assistants that highchairs should only be for eating and or activities. Once child is done with eating and or activities child should be taken off highchairs. Additionally, LPA advised that car seats are only for transportation.

LPA did not observe the following items during the inspection: Infant Walkers, Johnny Jumpers, Saucer Chairs, Trampolines and/or any other item that fall into these categories are not permitted in a family child care facility.

Smoking is prohibited in a licensed Family Child Care Home. Per Licensee, no one smokes in the home.

Currently, children are using the back yard for outdoor play time. The outdoor play area was observed to be fenced. LPA observed that the outdoor yard has toys and other materials for children to play with.
There are 3 dogs and 1 cat on the premises. Per Licensee, pets are in the off limits of the home.

The licensee is observed to be operating within the license capacity limitations.

At 3:30 pm children’s records and staff records were reviewed. Children’s records were observed to be complete. Upon record review LPA observed that the licensee and 3 assistants have completed training on preventive health practices including Pediatric First Aid and CPR. ----pg 3 of 5 ---

The licensee's and assistant’s Pediatric First Aid and CPR expires on 4/2023. LPA observed that Staff # 5 does not have proof of CPR training. There are first aid supplies available.

LPA observed that the Licensee and assistant do have proof of immunization record and the Mandated Reporter AB 1207 compliant Child Care Training Certificate on file. The required AB1207 expires on 4/28/2023

LPA issued a copy of the LIC 857 Children’s Records Review and the LIC859 Staff Records Review to the licensee during this inspection.

Incidental Medical Services (IMS) policy was discussed. For IMS information see Evaluator Manual - Regulation Interpretations and Procedures for Family Child Care Homes Section 102417. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. LPA advised the licensee to access forms, regulations and quarterly updates on line at: www.ccld.ca.gov

Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

Based on the LPA’s observations and records reviews, the following deficiencies listed on the attached LIC 809D (deficiency page) are being cited in accordance with California Code od Regulations Title 22. Deficiencies that are being cited need to be cleared to protect the children’s health and safety.

A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
