Licensing Program Analyst (LPA) Alicia Mooberry conducted an unannounced Case Management Annual - continuation visit. Upon arrival, LPA met with the Licensee Mirna Jaurequi and informed of the purpose for the visit which was completed facility inspection and review records. Inspection conducted in English and Spanish LPA provided the inspection Entrance Checklist (LIC 126). Licensee guided LPA on a tour of the facility. Individuals residing in the home have been discussed and noted. Licensee provides care to children ages newborn to 13 years old and operation days/ hours are Monday through Friday 6:00 AM to 6:00 PM.

Upon arrival at 3:00pm the licensee was supervising 6 children including 1 infant. At 3:15pm 7 school aged children arrived, bringing the facility to 13 total children. Since the licensee did not have an assistant, the facility was over the capacity limitations, posing an immediate risk to the health and safety of children in care. Authorized representatives picked up children between 3:15-4:00pm. By 3:49, there were 8 children in care.

Areas that are used by children were inspected for safety, comfort, cleanliness, telephone service, ventilation, and heating. Rooms that are off-limits need to be made inaccessible during operating hours. The licensee does understand that licensing staff may have access to off-limit areas during inspection visit if necessary.

During this inspection LPA observed that the facility is in compliance regarding Pool Safety AB2866. LPA observed the sliding glass door leading to the backyard where pool is located has been replaced and is locked.

LPA observed the facility license, Publication (PUB) 394- Notification of Parent Rights and Licensing Form (LIC) 9148- Earthquake Preparedness form posted in daycare room. Licensee was reminded to always ensure the required posted documentation in a location visible to parent/guardians of children in care. LPA reviewed completed facility records including LIC 9040- Facility Roster, LIC 610- Facility Disaster Plan.

Smoke and carbon monoxide detectors were tested and are operable. Fire extinguisher indicated fully charged and was serviced in last 12 months. The home is observed to be clean and orderly. There are toys and other age-appropriate material available. LPA observed that cleaning compounds are in laundry area in locked cabinets. The bathroom that children use is in the daycare room, clean and free of hazards.

Per Licensee there are no firearms or weapons stored in the home. Area for sick children waiting to be picked up is in the living room, supervised and away from the other children.

LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. LPA reminded licensee that products such as baby rockers, sliders, and any such item inteded for sleeping should not be used for daycare children.

Currently, children are using the back and front yard for outdoor play. The outdoor play area was observed to be fenced. Per licensee, the children are always supervised when playing outside due to in-ground pool. There is one small dog that is kept in gated area in the backyard and inaccessible to children in care.

Licensee, staff and Children’s records were reviewed for and are complete. LPA reminded licensee to ensure all documents are updated as needed.

Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02-CCP. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. Licensee was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain childcare by connecting them to childcare providers and Resource and Referral Agencies (R&Rs) throughout California.

Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

Based on the LPA's observations and records review 1 A deficiencies is cited today in accordance with California Title 22 Regulations.

A copy of this report shall be provided to the parent/guardian of children currently enrolled by the next business day or immediately upon return. A copy of this report shall also be provided to the parent/guardian of any newly enrolled children for the next 12 months (1 year). The Acknowledgement form must be maintained in each child’s file immediately upon receipt from parent. Licensee/Director was provided with a copy of the parent Acknowledgement of Receipt of Licensing Reports Form during this visit. A copy of the Parent Notification Requirements was also provided to the licensee/Director.

During the exit interview, the licensee, confirmed that there are no Registered Sex Offenders (RSO) living in the facility and LPA completed the RSO search in Megan’s Law Website.

A notice of site visit was given and must remain posted for 30 days.

Exit interview conducted and report was reviewed with the licensee Mirna Jaurequi, Appeal rights were discussed and provided.
