25 | Licensing Program Analysts (LPAs) Monique Ayala and Jessica Hopkins-Hernandez arrived on February 27, 2024 for an unannounced inspection to follow up on a Substantiated allegation/complaint investigation.
On 12/21/2023, the Department concluded a substantiated complaint which alleged the following allegations: Adult engaged in inappropriate behavior with day care child.
The allegation was Substantiated on 12/21/2023, and the licensee was cited under California Code of Regulations (CCR) 102423(a)(2), Personal Rights. A Type A deficiency was issued as the incident did occur during day care hours. Based on the evidence, an immediate exclusion action against licensee’s son, Johnny Romero, was taken on 11/16/2023. An individual may be excluded from employment in a licensed facility or having contact with clients of a facility if he/she engaged in conduct specified in the Health and Safety Code and the Title 22 of the Code of Regulations, including, but not limited to, conduct which is inimical to the health, welfare, or safety of an individual in or receiving services from a licensed facility. On 12/07/2023, licensee was cited a Type A deficiency, CCR: 102416(d)(1)- Personnel Requirements, for not following the Letter of Immediate Exclusion dated 11/16/2023. Licensee stated she had misunderstood the exclusion meant, at all times. According to licensee, it was her understanding that her son could not be in the home while day children were present. Civil Penalties were issued on 12/07/2023. Licensee was found to be in compliance at the follow-up inspection completed on 12/19/23. |
