Licensing Program Analyst (LPA) Katrina Chicote conducted an Unannounced - Case Management inspection on 03/17/22 to follow up on an incident that was reported to the Department on 03/07/22. Upon arrival, LPA initially met with Marta Macias, who provided LPA a tour of the facility and guided LPA to Classroom 02, where reported incident took place. Census was taken, LPA observed three staff members and twelve children at time of inspection. Regional Site Director, Ruzanna Davatian, joined LPA upon arrival to facility at 10:37 AM.

On 03/07/22, an incident was reported to The Department that a parent reported to facility that they observed a child being handled roughly by Staff 3(S3). Per Regional Site Director, she was notified of the incident at end of day on Friday, 03/04/22 and the incident was reported to Department by facility's care and supervision team on 03/07/22. The facility reported this incident to the Department within the required 24 business hours.

During this inspection, LPA interviewed three staff members who work in the classroom where incident occurred and Regional Site Director. Regional Site Director informed licensing that facility put S3 on administrative leave as they conducted an investigation of incident. Facility investigated incident for one week and found the incident to be unfounded. Regional Site Director stated they observed incident captured on cameras they have at facility and they did not observe corroborating information that pertains to incident. Staff 1(S1) and Staff 2(S2), were interviewed during inspection, to which they discussed that they did not observe S3 handle child roughly. S2 described bathroom policy, stating that they take children to the bathroom constantly, both when initiated by children as well as reminding children all through the day. children away from unsupervised area, but denies that she pulled or pushed them in a rough manner. S3 demonstrated to LPA how she guided the children at time of inspection. LPA observed the indoor classroom where the incident took place. LPA obtained and reviewed documentation. Based on the information obtained and LPA observation and interviews, LPA determined there was no violation of personal rights and adequate supervision was provided the day of the incident.

The facility was found in compliance per Title 22 regulations, there will be no deficiencies cited today 03/17/22.

A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

Exit interview was conducted and report was reviewed with the Licensee (or facility representative), Ruzanna Davatian, Regional Site Director.
