On November 07, 2024, Licensing Program Analysts (LPAs) Monique Ayala and Mariah Aguirre conducted an unannounced compliant investigation for the above allegation. A COVID-19 risk assessment was conducted prior to entering the facility. LPAs met with Site Supervisor Graciela Cerezo who guided LPAs on a tour of the facility. LPAs observed 28 children in care with 8 staff members.

During the investigation, LPAs obtained a copy of the facility roster, interviewed Staff #1 (S1) to Staff #3 (S3), interviewed Child #2 (C2) to Child #4 (C4), interviewed Parent #1 (P1) to Parent #3 (P3), reviewed video surveillance footage. LPA Ayala requested Police Report from Sheriff Department on 10/29/2024 and 11/06/2024, there were responses. LPAs were unable to interview the Reporting Party (RP), as the RP is anonymous. LPAs were unable to interview Child #1 (C1).

RP alleged, “Staff injured child while in care”. Per RP, C1’s elbow was dislocated by a staff member.

During the investigation, LPAs reviewed video footage and observed S1 spinning C1 in a circle but were unable to verify how C1 was being spun. LPAs interviewed S1 who stated she playing with C1 outside in the play yard and spun C1 in a circle while holding C1's wrist. Per S1, P1 was called and informed that C1 was in discomfort during lunch time stating C1's arm hurt. Per P1 when she came to pick up C1, there was no clarification on what had occurred with C1. P1 stated that C1 was taken to seek medical attention where it was determined that C1 had a dislocated elbow that needed to be placed back into the socket. During interviews it was disclosed that no other staff members or children observed the incident. There were no corroborating statements from P2-P3.

Based on interviews conducted and video surveillance footage, the above allegation is deemed SUBSTANTIATED. S1 disclosed that C1 was spun in a circle during outside play time and S1 was spinning C1 by her wrists. A finding of Substantiated means that the preponderance of evidence standard has been met.

The facility is being cited a Type A deficiency is accordance with Title 22 Regulation code, Personal Rights 101223(a)(2), see LIC9099D. Per Site Supervisor, there were meetings held with all staff on 10/29/2024 and 11/01/2024 where appropriate handling of children was reviewed and personal rights were discussed. Site Supervisor provided LPAs with a copy of the meeting agenda and staff signatures of who attended.

A copy of this report shall be provided to the parent/guardian of children currently enrolled by the next business day or immediately upon return. A copy of this report shall also be provided to the parent/guardian of any newly enrolled children for the next 12 months (1 year). The Acknowledgement form must be maintained in each child’s file immediately upon receipt from parent. Site Supervisor was provided with a copy of the parent Acknowledgement of Receipt of Licensing Reports Form (LIC9224) during this visit. A copy of the Parent Notification Requirements was also provided to the Site Supervisor.

An exit interview was conducted, and a copy of this report was provided to Site Supervisor, Graciela Cereza along with Appeal Rights. A Notice of Site Visits was provided and must be posted for 30 days.

Per S1 when transitioning inside, C1 stated her arm was hurting. C1 sustained a dislocated elbow. This poses an immediate health and safety risk for children in care.
