Licensing Program Analysts (LPAs) Roxana Lopez and Enjoli Maeweather conducted a Complaint Investigation on this date. Risk assessment was conducted upon entry and appropriate PPE was used. The purpose of this visit is to provide findings of the complaint investigation which was received on 9/23/2022. LPA met with Sara Krikorian Director, to whom the purpose of the inspection was announced. A tour of the facility was given, and census was taken.

Throughout the course of the investigation, interviews were conducted with reporting party, staff, and parents. LPA also reviewed and obtained copies of children’s rosters, personnel report, pictures, and other supporting documents.

Per initial complaint reporting party reported, that C1 was not kept cleaned and dried, diapering needs were not met, C1 was placed in car seat and not strapped in properly.

Regarding allegation #1 and # 2: Staff did not keep infant clean and dry at all times and staff did not ensure the child’s diapering needs were met. LPA conducted interviews reporting party and staff 1-4. Reporting party states that when they picked C1 up from car seat C1’s clothing were wet, soiled and smelled like milk. Reporting party is unsure of how long C1 was in the car seat. According to reporting party 13 diapers were dropped off in the morning and 2 were missing in the afternoon.

LPA received pictures of C1 and C1’s clothing before and after pick up. LPA observed C1 wearing the same clothing in the afternoon. Pictures after pick up visibly show neck of outfit, sleeves and back to be dirty, wet and yellowish stains, the edges of the light pink bloomers are a darker pink indicating wetness. LPA interviewed S1 who stated that children’s diapers are checked every two hours and changed if needed. Per S1 before their shift is over, they make sure that the infants have dry diaper and new clothes if needed. Dirty clothes would be placed in a plastic bag for parents to take home. Additionally, LPA reviewed documentation of diaper changes - LPA observed that C1 only had two diaper changes documented during the approximate 8 - hour day the infant was present. LPA did not observe any dry diapers documented. This document corroborates with reporting party disclosure of dropping off C1 with 13 diapers and only 2 missing.

Regarding allegation #3 and # 4: Staff utilized infant’s car seat outside of the manufacturer’s instructions and staff transported infant in an unsafe manner. Reporting party disclosed that when they picked up C1, they found C1 in car seat with a bottle next to their cheek. Per reporting party S1 inform them that baby was not strapped in and left facility in a hurry. LPA interviewed staff 1 – 4. S1 disclosed that their departure time was approaching, since they were the only teacher in the classroom and the covering teacher had not arrived yet, they did place C1 in the car seat without strapping them. S1 states that they put a blanket on top of C1’s legs and a bottle on the side- that way C1 was ready to go as they were informed that parent was arriving. S2 and S4 corroborated that C1 was in a car seat without being strapped in when parent arrived.

This agency has investigated the complaint alleging staff did not keep infant clean and dry at all times, staff did not ensure the child’s diapering needs were met, staff utilized infant’s car seat outside of the manufacturer’s instructions and staff transported infant in an unsafe manner

Based on LPA’s observations and interviews which were conducted and record reviews, the preponderance of the evidence standard has been met, therefore the above allegations are found to be SUBSTANTIATED. California Code of Regulations, (Title 22, Division 12 & Chapter 3 (FCC) (1 DCC) number) are being cited on the attached LIC9099D.

This poses an immediate health and safety risk to children in care. Title 22 Regulation Section 101223 Personal Rights states (a) The licensee shall ensure that each child is accorded the following personal rights: (2) To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs.

LPA Roxana Lopez informed Sara Krikorian that this report dated 10/25/2022 document(s) 1 Type A citation(s) which shall be posted for 30 consecutive days as there is/are immediate risk(s) to the health, safety, or personal rights of children in care.

Also, LPA Roxana Lopez informed the facility representative to provide a copy of this licensing report dated 10/25/2022 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

A notice of site visit was given and must remain posted for 30 days.

Per initial complaint reporting party reported, that during drop off staff handled infant in a rough manner as they grabbed C1 off parent’s arms. Reporting party stated that when they picked up C1 in the afternoon the infant classroom was stuffy and hotter than outside.

In regards to allegation # 1 staff handled infant in a rough manner and allegation # 2 staff did not maintain a comfortable temperature in the infant room. LPA conducted interviews with staff # 1- 4. All staff statements corroborated that they have not treated any child in a rough manner and have not observed a child treated in a roughly manner at any time. Staff # 1-4 corroborated that air conditioner in the classroom is turned on in the morning when facility opens and it’s turned off in the afternoon when the last child leaves.

LPA conducted interviews with parents. Parent’s statements corroborate that they do not have any concerns with teachers, that they are happy with the care their child receives. Parent also corroborated that the infant room has not felt hot even though the temperature has been hot outside. During inspection LPA observed the air conditioner to be on and entire classroom was cool.

This agency has investigated the complaint alleging staff handled infant in a rough manner and staff did not maintain a comfortable temperature in the infant room. Based upon the evidence as presented above, the allegation has been determined to be Unsubstantiated. A finding of Unsubstantiated means that although the allegation may have happened or is valid, there is not a preponderance of evidence to prove alleged violation(s) did or did not occur, therefore at this time the above allegation is unsubstantiated.

A notice of site visit was given and must remain posted for 30 days.
