Licensing Program Analyst (LPA) Seung Lee conducted an unannounced complaint inspection. Upon arrival LPA Lee met with Licensee Claudia Hernandez

During the course of this investigation, LPA Lee conducted interviews, reviewed documents, and made observations in regards to the above allegations.

The complaint alleges that an adult who is not fingerprint cleared (Adult#1) is present at the facility during business hours. The complaint goes on to state that children in care are being left unattended and being exposed to domestic violence due to Adult#1 being present at the family child care home. The Licensee denied the allegations and made no disclosure. The Licensee did state that while Adult#1 has been present at the home in the past, it was always during weekends or holidays when children in care are not present. The reporting party was not available to interview during the course of this investigation.

During the investigation, multiple inspections were conducted at different times. LPA Lee did not observe anything that went against or supported the above allegations. Interviews with parents of children in care, and children in care were conducted and attempted. LPA Lee did not observe any information from the interviews that went against or supported the above allegations. During the inspection conducted on this date, LPA Lee inspected the off limits area of this home. LPA Lee did observe anything that supported or went against the various allegations.

Based on the evidence collected during the investigation, the allegations that daycare children are being left unattended and being exposed to domestic violence, uncleared adult on the premises, and facility did not provide a safe and comfortable environment for daycare children may be valid. However, there is not enough preponderance of evidence to prove the alleged violation(s) did or did not occur, therefore at this time the above allegation are found to be unsubstantiated.

The notice of site inspection must remain posted for a period of 30 days during hours of operation. Failure to maintain posting for 30 days during hours of operation may result in a civil penalty of $100.00 dollars.

Exit interview conducted with Licensee Claudia Hernandez. Appeal rights discussed and explained.
