Licensing Program Analyst (LPA) Seung Lee conducted an unannounced complaint inspection. Upon arrival LPA Lee met with Licensee Claudia Hernandez.

During the course of this investigation, LPA Lee conducted interviews, reviewed documents, and made observations in regards to the above allegations.

The complaint alleges that on 07/08/2024 sometime between 4:30PM- 5:00PM, the Licensee was observed outside the family child care home arguing with Adult#1. The reporting party stated this was observed by another individual who then informed the reporting party. The reporting party also stated children in care were left unattended during this time when Licensee was allegedly outside with Adult#1, and that Adult#1 resides at the facility. The reporting party did not state how they knew children in care were left unattended, and did not clarify if the individual that saw the alleged intereaction on 07/082024 was a parent of a children that attends the facility.

LPA Lee attempted to contact the reporting party but was unable to despite multiple attempts. The Licensee denied the allegations made no disclosure. The Licensee stated that no children in care were present when Adult#1 was at or near the family child care home. During multiple unannounced inspections conducted during this investigation, LPA Lee did not observe any signs of Adult#1 in the facility or in the parking lot of the facility. The reporting party stated that Adult#1 is present all the time and provided a description of Adult#1's vehicle. Records obtained from local law enforcement and a resource and referral agency were reviewed during this investigation. The records did not produce any evidence that supported or went against the allegations.

Based on the evidence collected during the investigation, the allegations that daycare children are being left unattended, and uncleared adult on the premises may be valid. However, there is not enough preponderance of evidence to prove the alleged violation(s) did or did not occur, therefore at this time the above allegation are found to be unsubstantiated.

The notice of site inspection must remain posted for a period of 30 days during hours of operation. Failure to maintain posting for 30 days during hours of operation may result in a civil penalty of $100.00 dollars.
