Licensing Program Analyst (LPA) Ashley Calderon arrived at the facility to conduct an unannounced Health and Safety Check at the above facility. Upon arrival LPA met with resident Minor #1 who stated they reside in the home. LPA disclosed purpose of today's visit and asked to speak to Licensee Angela Huffman.

Minor #1 informed LPA Calderon Licensee A.Huffman is not present. LPA Calderon asked if there are day care children present, Minor #1 informed LPA day care is currently closed but there will be day care children in the afternoon. LPA asked Minor #1 if there are day care staff present Minor #1 stated no. LPA Calderon heard a crying child who Minor #1 stated that is their foster sibling Minor #2 (names noted on a confidentiality list) .

LPA Calderon via telephonically contacted Licensee Angela Huffman, who stated will arrive at the facility shortly. At approx. 10am Licensee A.Huffman arrived at the facility who allowed LPA entrance into the facility. LPA disclosed the purpose of today's visit and requested a tour of the facility inside and out; tour conducted alongside A.Huffman. LPA observed that there were two minor children present, Minor #1 was baby sitting Minor #2; no other individuals present until Licensee arrived to the home. LPA observed 0 day care children present. Minor #1 is not counted in the day care census due to their age being over 10 years old and Minor #2 is not counted in the census during this visit due to day care children census being 0 during time of visit.

Per Licensee, hours of operation remain the same; day care is opened 24 hours 12am to 11:59pm. Per Licensee open today and hasn't had any day care children this morning and informed LPA Calderon unknown what time their grandchildren will arrive. LPA Calderon requested LIC9040 Children's Roster during visit, A.Huffman was unable to locate roster; LPA requested to email Children Roster. ( LIC 809-C)

FACILITY EVALUATION REPORT California law requires a public report of each licensing visit/inspection. This report is a record for the facility and the licensing agency. This report is available for public review; therefore, care is taken not to disclose personal or confidential information. Inquiries concerning the location, maintenance, and contents of these reports may be directed to the Licensing Program Analyst or Regional Office whose address and telephone number are listed on the front of this form.

DEFICIENCIES A deficiency is an instance of noncompliance with licensing requirements, including applicable statutes, regulations, interim licensing standards, operating standards, and written directives. Applicants/ licensees must be notified in writing of all licensing deficiencies. Deficiencies are listed on the left side of this form, and the applicable licensing requirement upon which the deficiency is identified. There are two types of deficiencies:
  • Type A deficiencies are violations of licensing requirements that, if not corrected, have a direct and immediate risk to the health, safety, or personal rights of persons in care.
  • Type B deficiencies are violations of licensing requirements that, without correction, could become a risk to the health, safety, or personal rights of persons in care, a recordkeeping violation that could impact the care of said persons and/or protection of their resources, or a violation that could impact those services required to meet the needs of persons in care.

PLANS OF CORRECTION (POCs) The licensing agency is required to establish a reasonable length of time to correct a deficiency. In order to set the time, the licensing agency must take into consideration the seriousness of the violation, the number of persons in care involved, and the availability of equipment and personnel necessary to correct the violation. Applicants/licensees are requested to provide a specific plan for each violation on the right side of the form across from each deficiency. The more specific the plan, the less chance exists for any misunderstanding in setting time limits and reviewing corrections. The applicant/licensee who encounters problems beyond their control in completing the corrections within the specified time frame may request and may be granted an extension of the correction due date by the licensing agency.

CORRECTION NOTIFICATION The applicant/licensee is responsible for completing all corrections and promptly notifying the licensing agency of corrections. Applicants/licensees are advised to keep a dated copy of any correspondence sent to the licensing agency concerning corrections, or if corrections are telephoned to the licensing agency, the date, person contacted, and information given.

CIVIL PENALTIES The licensing agency is required by law to issue a Penalty Notice, when applicable, to all facilities holding a license issued by the licensing agency, or subject to licensure, except Certified Family Homes, Resource Families, and Foster Family Homes, or any governmental entity.

PENALTY NOTICE GIVEN The statement concerning civil penalties serves as a penalty notice on this Licensing Report and failure to correct cited licensing deficiencies will result in civil penalties. Applicants/ licensees are required to pay civil penalties when administrative appeals have been exhausted and in accordance with any payment arrangements made with the licensing agency.

APPEAL RIGHTS The applicant/licensee has a right without prejudice to discuss any disagreement in this report with the licensing agency concerning the proper application of licensing requirements. The applicant/ licensee may request a formal review by the licensing agency to amend or dismiss the notice of deficiency and/ or civil penalty. Requests for review shall be made in writing within 15 business days of receipt of a deficiency notification or civil penalty assessment. Licensing deficiencies may be appealed pursuant to the procedures in the LIC 9058 Applicant/Licensee Rights.

AGENCY REVIEW The licensing agency review of an appeal may be conducted based upon information provided in writing by the applicant/licensee. The applicant/licensee may request an office meeting to provide additional information. The applicant/licensee will be notified in writing of the results of the agency review within 60 business days of the date when all necessary information has been provided to the licensing agency.

EMAIL REQUIREMENT Adult Community Care Facilities, Residential Care Facilities for the Chronically Ill, and Residential Care Facilities for the Elderly are required to provide and maintain an active email address of record with the licensing agency.

LPA Calderon observed detergents Lysol Laundry Sanitizer Liquid Bottle, a Bag of Tide Pods, Softener sheets, and White Barn Fabric Care Detergent on top of the laundry machine in the garage that the day care children use due to accessibility LPA Calderon asked Licensee A.Huffman how does the facility ensure detergents are out inaccessible when day care children are present. Licensee A.Huffman informed LPA Minor #1 was washing since there is no children and there was free time in the day and items are put in a box in Licensee's room (off limits) that were detergents are stored or detergents are placed in the high to reach cabinet above the laundry machines, LPA observed cabinet that is inaccessible to children and, pictures were taken. LPA Calderon reminded Licensee to place cleaning compounds and detergents out of reach and inaccessible to day care children when present.

LPA Calderon observed baby rocker in the day care garage, picture taken, LPA interviewed Licensee Huffman asking who uses the baby rocker, Licensee informed LPA Calderon it is their grandbaby and their mother brought it to the home. LPA asked when is the baby rocker used Licensee Huffman informed LPA not during day care use. LPA informed Licensee baby rockers are not to be used for day care children when operating day care and to place rocker in an off limit area.

LPA Calderon observed two broken toys in outside yard, a broken bumble bee car missing right side back wheel and a wooden play structure car that the passenger side frame wood was observed broken, Licensee stated due to having no day care children yet, the back yard (play area) has not been cleaned up and will clean up the yard before day care children arrive today. LPA observed at the time of visit Licensee A.Huffman tossing the bumble bee car in the trash. LPA Calderon reminded Licensee to ensure toys, materials and equipment for children are safe and to ensure when day care children are present they receive healthful accommodations.

Licensee A.Huffman had to leave the facility to take Minor #2 to a visit, therefore LPA Calderon left facility at approx. 10:20am. An exit interview was conducted via telephonically at 11:44am due to Licensee Angela Huffman stepping out of the home. LPA provided report, appeal rights and a notice of site visit to post for 30 days to Facility Representative Dominque Huffman.
