Licensing Program Analyst Veronica Martinez Garza conducted a Case Management-Incident inspection on 05/08/26 at 01:16 p.m. The purpose of this inspection is to follow up on an incident reported to the Department within 24 hours. At 01:22 p.m. LPA met with the facility representative Kenia Villegas who guided LPA on a tour of the facility and census was taken. According to the facility representative, the preschool program did not operate today due to being staff development day; however, staff and children from the day care program were present.

During this inspection, LPA interviewed Staff 1 (S1 thru 2) and obtained additional documentation pertaining to the incident. C1 was not interviewed due to napping/resting their body and was then picked up by their parent. C2 was not interviewed due to not being present during the inspection.

On 05/01/26 at approx. 01:47 p.m. while playing in the playground child #1 (C1) fell from the top of the straight crawl tunnel that is attached to the play structure. According to the unusual incident report C1 crouched down and jumped off the tunnel landing on their right elbow/forearm area and soft turf. Staff assessed C1 and asked the child to move their arm up and down and to try to pick up their arm as it was observed to be drooping to the side. C1 was able to move their arm and slightly lift it; however, the child seemed to be uncomfortable. S2 radioed for an ice pack and notified S1 who then assessed C1. S1 notified parent of C1 of the incident and asked them to pick up the child for further assessment.

LPA interviewed S1 and revealed that they were radioed for an ice pack and assistance was needed at the playground due to C1 falling from the tunnel. According to S1, upon arrival to the playground they provided an ice pack and assessed C1. S1 notified parent of C1 of the incident via phone, the parent was asked to pick up the child for further assessment, and during pick up an ouch report was provided.

FACILITY EVALUATION REPORT California law requires a public report of each licensing visit/inspection. This report is a record for the facility and the licensing agency. This report is available for public review; therefore, care is taken not to disclose personal or confidential information. Inquiries concerning the location, maintenance, and contents of these reports may be directed to the Licensing Program Analyst or Regional Office whose address and telephone number are listed on the front of this form.

DEFICIENCIES A deficiency is an instance of noncompliance with licensing requirements, including applicable statutes, regulations, interim licensing standards, operating standards, and written directives. Applicants/ licensees must be notified in writing of all licensing deficiencies. Deficiencies are listed on the left side of this form, and the applicable licensing requirement upon which the deficiency is identified. There are two types of deficiencies:
  • Type A deficiencies are violations of licensing requirements that, if not corrected, have a direct and immediate risk to the health, safety, or personal rights of persons in care.
  • Type B deficiencies are violations of licensing requirements that, without correction, could become a risk to the health, safety, or personal rights of persons in care, a recordkeeping violation that could impact the care of said persons and/or protection of their resources, or a violation that could impact those services required to meet the needs of persons in care.

PLANS OF CORRECTION (POCs) The licensing agency is required to establish a reasonable length of time to correct a deficiency. In order to set the time, the licensing agency must take into consideration the seriousness of the violation, the number of persons in care involved, and the availability of equipment and personnel necessary to correct the violation. Applicants/licensees are requested to provide a specific plan for each violation on the right side of the form across from each deficiency. The more specific the plan, the less chance exists for any misunderstanding in setting time limits and reviewing corrections. The applicant/licensee who encounters problems beyond their control in completing the corrections within the specified time frame may request and may be granted an extension of the correction due date by the licensing agency.

CORRECTION NOTIFICATION The applicant/licensee is responsible for completing all corrections and promptly notifying the licensing agency of corrections. Applicants/licensees are advised to keep a dated copy of any correspondence sent to the licensing agency concerning corrections, or if corrections are telephoned to the licensing agency, the date, person contacted, and information given.

CIVIL PENALTIES The licensing agency is required by law to issue a Penalty Notice, when applicable, to all facilities holding a license issued by the licensing agency, or subject to licensure, except Certified Family Homes, Resource Families, and Foster Family Homes, or any governmental entity.

PENALTY NOTICE GIVEN The statement concerning civil penalties serves as a penalty notice on this Licensing Report and failure to correct cited licensing deficiencies will result in civil penalties. Applicants/ licensees are required to pay civil penalties when administrative appeals have been exhausted and in accordance with any payment arrangements made with the licensing agency.

APPEAL RIGHTS The applicant/licensee has a right without prejudice to discuss any disagreement in this report with the licensing agency concerning the proper application of licensing requirements. The applicant/ licensee may request a formal review by the licensing agency to amend or dismiss the notice of deficiency and/ or civil penalty. Requests for review shall be made in writing within 15 business days of receipt of a deficiency notification or civil penalty assessment. Licensing deficiencies may be appealed pursuant to the procedures in the LIC 9058 Applicant/Licensee Rights.

AGENCY REVIEW The licensing agency review of an appeal may be conducted based upon information provided in writing by the applicant/licensee. The applicant/licensee may request an office meeting to provide additional information. The applicant/licensee will be notified in writing of the results of the agency review within 60 business days of the date when all necessary information has been provided to the licensing agency.

EMAIL REQUIREMENT Adult Community Care Facilities, Residential Care Facilities for the Chronically Ill, and Residential Care Facilities for the Elderly are required to provide and maintain an active email address of record with the licensing agency.

Per S1, after the incident and during pick up, the child remained with an ice pack and there was no swelling or bruising observed on the child’s elbow/forearm.

Interviews conducted with S2 revealed that they were near the play structure trying to separate 2 children when C2 told the staff that C1 had sustained an injury. Per S2, C1 approached them while holding their droopy arm and seemed to be in shock. S2 asked C1 what happened and the child replied that they jumped from the tunnel but then stated I don’t know.

Staff interviewed corroborated that C1 was asked to move/lift their arm but observed that the child flinched and was uncomfortable. Staff also revealed that children are allowed to sit on top of the tunnel; however, they cannot stand or jump from the tunnel. According to the staff, there were 15 children with 03 staff present in the playground. The parent left the premises with C1 and stated that they would take the child to urgent care. S1 stated that they requested updates from the parent of C1 and at 04:47 p.m., parent stated that the child’s Xray revealed there was a small broken bone on their elbow, a temporary cast would be placed, and later on a hard cast. Per S1, C1 returned to the facility on 05/04 with a sling and a temporary cast but without a doctor’s note;however, parent provided verbal instructions to the facility that were given to her by the doctor. Per staff, the only restriction mentioned by the parent was for the child not be “as active," lay on it, or put pressure. According to S1, C1 arrived to the facility today with a hard cast and verbal instructions provided by the doctor were to not wet the cast and to keep it for 8 weeks.

LPA toured the playground and observed all play structure in good condition. The entire playground has a cushioning material that absorbs a fall and was observed to be in good condition as well. Upon research of the play structure, LPA observed that it is age appropriate since the age range for the structure is from 6 to 23 months and 2 to 5 years old. The structure is identified as an Infant Maze that has an attached straight crawl tunnel, and the crawl tunnel’s material is made of Polyethylene primarily used in commercial/playground equipment for children. Currently, preschool children will not be using the playground where the incident occurred to prevent further incidents or injuries and will be utilizing the side playground for outdoor play.

At this time, the facility is in compliance with California Title 22 Regulations. Therefore, there are no deficiencies being issued today.

A notice of site visit was given and must remain posted for 30 days.
