On 03/12/2024 at 09:07 a.m., Licensing Program Analyst (LPA) Veronica Martinez Garza conducted an unannounced complaint investigation to deliver findings to the above allegations. Upon arrival LPA met with Licensee Rosaura Roa who guided LPA on a tour of the facility. LPA observed 02 children in care.

According to the Reporting Party (RP), “Licensee force fed a daycare child while in care.”

During the course of the investigation, LPA interviewed Staff 1 (S1 thru 2), Child 1 (C1 thru 2) and Parents 1 (P1 thru 4). LPA also obtained a copy of the facility roster.

Allegation regarding- Licensee left a daycare child unattended in the bathroom. According to the RP, S1 left a two-year old child crying for over an hour in the bathroom. RP does not identify who the two-year old is. LPA interviewed S1 thru 2, who made no disclosures. S1 denies leaving children unattended in the bathroom and denies leaving children crying for more than 1 hour in the bathroom. Per S1, the bathroom door remains open, and they wait by the door. S1 also stated that when children choose not to use the potty they are removed from the bathroom. According to S2, they recently started working with S1 and deny children are left unattended in the bathroom. LPA conducted child interviews. According to C1, they have observed S1 leave C3 unattended in the bathroom. According to C1, C3 is left alone approximately 5 minutes. C1 also stated that when C3 wants to leave the bathroom, S1 tells C3 that they must stay in the “potty” until C3 “pees” or “poops.” According to C1, C3 is observed to be crying. According to C2, C3 is left in the bathroom approximately 10 to 20 minutes, however, LPA was unable to determine if C2 can make a determination regarding length of time. C2 also stated that C3 asks S1 if they can get out of the bathroom and S1 is heard telling C3 to stay in the bathroom if they didn’t poop. LPA conducted interviews with P1 thru 4 on 12/06/23 and 12/27/23, who made no disclosures and do not have issues or concerns regarding S1.

This agency has investigated the complaint alleging “Licensee left a daycare child unattended in the bathroom.” Interviews conducted found that LPA could not confirm or deny that C3 was left unattended in the bathroom for more than 1 hour. Based on the information obtained, the complaint is deemed to be UNSUBSTANTIATED. Meaning that, although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation occurred.

A notice of site visit was given and must remain posted for 30 days.

Allegation regarding- Licensee force fed a daycare child while in care. According to the RP, S1 force fed a two-year-old even when the child didn’t want to eat. Per RP, Licensee would force food in the child’s mouth, while closing the mouth until the child would swallow. LPA interviewed S1 thru 2, who made no disclosures. S1 denies force-feeding children. According to S1, they feed children under 1 ½ and help children eat when they can’t eat on their own. S1 also denies shoving food in the children’s mouth until it has been swallowed. According to S2, they recently started working with S1 and deny children are forced to eat. S2 stated that they assist younger children who need help eating. LPA conducted additional interviews with children. According to C2, it has been observed that C3 gets sad and cries when S1 pushes the spoon in C3s mouth. C2 stated that it has been witnessed that C3 is the only one that is forced to eat since the other children eat on their own. LPA conducted interviews with P1 thru 4 on 12/06/23 and 12/27/23, however no disclosures were made and/or had concerns with S1.

LPA provided information regarding the Technical Support Program (TSP), process of TSP, and explained that it is voluntary. LPA also provided a TSP brochure.

Based on interviews, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. California Code of Regulations, Title 22, Division 12, Chapter 1, the following deficiencies are being cited (see attached 9099D).

Upon receipt, the Licensee shall post the “D” page of the Licensing report. This page shall be posted for 30 consecutive days. Failure to maintain posting as required will result in a $100 civil penalty. A copy of this report shall be provided to the parents/guardians of the children currently enrolled by the next business day or immediately upon return. A copy of this report shall also be provided to the parents/guardians of any children newly enrolled at the facility for the next 12 months. The LIC 9224 Acknowledgement of Receipt of Licensing Reports must be maintained in each child's file immediately upon receipt from the parent. LPA provided Licensee with a blank copy of the LIC 9224 Acknowledgement of Receipt of Licensing Report.

A notice of site visit was given and must remain posted for 30 days.

These rights include, but are not limited to, the following:o be treated with dignity in his/her personal relationship with staff and other persons. S1 was observed forcing C3 to eat and was also observed pushing a spoon into C3s mouth which poses an immediate health, safety or personal rights risk to persons in care.
