On 07/03/2024, Licensing Program Analyst (LPA) Staicy Perry conducted an unannounced Annual inspection to the above facility. A COVID risk assessment was conducted upon entry. LPA was greeted by License Margareta Ortega, whom the reason for the visit was explained. Also present during inspection was licensees 2 assistants. Per Licensee, there are 12 children currently enrolled. There were 9 children, and 3 adults present in the home upon arrival. Facility capacity is in compliance for a Large Family Child Care Home. Per Licensee hours of operation are Monday-Friday 6:00am-6:00pm.

This is a one-story home which consists of 2-bedroom, 2-bathroom, kitchen, dining room, living room, and outside front yard (fenced). The children use the front bathroom, living room, dining room and front yard for play. Per licensee, areas off limits to children and parents include: 2 bedrooms and kitchen. There is a kiddie gate blocking entrance to the kitchen. Family members residing in the home are 3 adults (criminal record clearances on file).

LPA observed the following required posted documentation in the main entry way of the family childcare home: Facility License, Publication (PUB) 394- Notification of Parent Rights and Licensing Form (LIC) 9148- Earthquake Preparedness form. LPA reviewed facility records for LIC 9040- Facility Roster, LIC 610- Facility Disaster Plan and Disaster drill log. Children's roster was reviewed and is current.

Areas accessible to children were inspected to ensure that they are clean and orderly with ventilation and heating for safety and comfort. There are toys and other age-appropriate material available for children. There is a wall AC in the living room. There is a working telephone service maintained in the home. The bathroom was reviewed, LPA did not observe anything that can pose danger to the children in care. The kitchen was observed to be clean and organized. Knifes were seen to be placed in a locked cabinet in the kitchen making it inaccessible to the children via a child safety lock. The living room area was observed to be

clean and orderly. Home was observed to have plenty of age-appropriate toys for the children to use. Licensee had latches on cabinets with any potentially hazardous material.
All equipment meets the US Consumer Product Safety Commission safety standards which poses an potential risk to the health and safety of the children in care.

Detergents, cleaning compounds, and medications were observed to be inaccessible to children kept in a locked cabinet in the kitchen area below the sink. Medications are stored in the off-limit room of licensee. Per Licensee, there are no poisons in the home. LPA advised that any poisons should be locked under key or combination lock. Licensee states that are no firearms or weapons stored in the home. The living room couch is used as an isolation area for an ill child until an authorized representative arrives to pick up the child.

The valve on the required 2A 10BC fire extinguisher indicates fully charged and LPA observed proof of purchase date of October 11, 2023, which indicates it is fully charged and in green. Smoke and carbon monoxide detectors were tested and are operable and were observed to be in all areas of the house.

All homes shall conduct fire and disaster drills at least once every six months and document the date and time of each drill. Last drill documented was conducted on 6/12/2024. The home is observed to be clean and orderly. There are first aid supplies available. LPA observed licensee to have a first aid kit available and is located in the Dinning room area.

Per licensee, breakfast, lunch, PM snack is provided by licensee. Licensee uses a food program called Options For Learning. Licensee was advised that food brought from the children’s homes, all containers must be labeled with child’s name and properly stored or refrigerated. Licensee does not transport the children.

LPA toured the outdoor play area and inspected its safety and condition. LPA observed perimeter fencing which is free of miscellaneous debris/hazards. All trees, shrubs and plants are maintained. Plants were observed to be barricaded with a gate. Outdoor play yard was observed to have toys for the children to play. LPA did observe outside are to have adequate shade. LPA observed plenty of age-appropriate toys.

Licensee’s records were reviewed for approved Pediatric First Aid and CPR certification, expires 4/2025, LIC 508- Criminal Record Statement, Proof of immunization's against measles, pertussis and influenza or influenza declination, TB clearance or risk assessment, LIC 9108- Statement Acknowledging Requirement to Report Child Abuse and current Mandated Reporter Training Certificate on record and expires on 1/2026.

Children’s records were reviewed for (LIC) 282- Affidavit Regarding Liability Insurance, Immunization's Records, LIC 700- Identification and Emergency Information, LIC 627- Consent for Medical Treatment, LIC 995A Notification of Parents’ Rights, LIC 9227- Infant sleep form (0-12 months, and documentation of 15-minute Infant Sleep Check (0-24 months). LPA observed children’s records and were observed to be complete.

LPA created an LIC 857, Children’s Record Review, and LIC 811, confidential names which documents persons living in the home.

Per licensees, there are no pets on the premises.

Smoking is prohibited in a licensed Family Child Care Home. Per Licensees, no one smokes in the home.

LPA did not observe the following items during the inspection: Infant Walkers, Johnny Jumpers, Saucer Chairs, and/or any other item that fall into these categories are not permitted in a family childcare facility.

Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02-CCP. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. Licensee. Margarita was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

LPA discussed the safe sleep regulations with licensee, Estela and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

Infant Care: LPA reviewed Safe sleep regulations / documents, 15-minute sleep check documentation for infants 0-24 months were reviewed and on file for the department. LPA observed and inspected sleeping equipment for infants. Each infant has their individual bedding and is washed daily as required. Soiled bedding is replaced when wet or soiled and is placed in an area inaccessible to infants. LPA observed playpens for infants and cribs.

LPA advised licensee how to access forms, regulations, and quarterly updates on the Child Care Licensing website at www.ccld.ca.gov.

Licensee Margarita was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain childcare by connecting them to childcare providers and Resource and Referral Agencies (R&Rs) throughout California

During the exit interview, Licensee, Margarita, confirmed that there are no Registered Sex Offenders living in the facility.

Currently, the licensee, Licensee, Margarita is in compliance with California Code of Regulations Title 22. No deficiencies cited.

A notice of site visit was given and must remain posted for 30 days. Appeal rights were discussed and provided.

Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
