Licensing Program Analyst (LPA) Jeanette Estrada conducted an unannounced annual required inspection at the above facility on 3/20/22 at 10:30AM. LPA met with Licensee Dilcia Cornejo who guided analyst on a tour of the facility. There were 3 children present when LPA arrived. Facility capacity is in compliance for a small Family Child Care Home.
This home is divided into two dwellings with the same address. The Daycare is part of the first dwelling which consists of 3 bedrooms, 2 bathrooms, kitchen, dining room living room front yard and a fenced backyard . The children have access to the living room/dining room as the day care area, the kitchen, the bathroom next to the kitchen and the backyard. Per licensee, areas off limits to children and parents include: front yard, 3 bedrooms and one bathroom in the first dwelling and the entire second dwelling which consists of two bedrooms. The LPA toured all areas used by children during this visit. Off limit areas are made inaccessible via a locked door. Hours of operation are Monday to Friday 12AM to 11:59PM.
Individuals residing in the home have been discussed and noted. All adults present in the home have obtained a criminal record clearance or exemption.
All areas identified on the facility sketch that are accessible for children to use were inspected for safety, comfort, and cleanliness. The following was observed and reviewed during this inspection: LPA reviewed required posted documentation for Facility License, Publication (PUB) 394- Notification of Parent Rights and Licensing Form (LIC) 9148- Earthquake Preparedness form. Facility records were reviewed for LIC 9040- Facility Roster and Disaster drill log, last drill conducted on 2/9/22. Licensee had a copy of the Roster available during the inspection.
Smoke and carbon monoxide detectors in the day care area were tested and are operable. The 2A10BC Fire extinguisher is located at the entrance to the facility. It indicated fully charged and was serviced on 11/21. The home maintains telephone service via cell phone. The home is observed to be clean and orderly. There are toys and other age appropriate materials available for children. Food is provided by Licensee. Licensee was reminded if children bring food from home it must be labeled with the child’s name and properly stored or refrigerated.

Children use the bathroom located next to the kitchen. Per the Licensee, the children are assisted when using the bathroom. The children are walked through the kitchen by the Licensee. LPA observed a safety gate installed at the kitchen entrance. Detergents, cleaning compounds and medication are stored in the kitchen in latched cabinets, inaccessible to children. At the moment there are no children enrolled who require medications. There is an A/C unit available in the playroom and a portable heater when needed. Licensee stated there are poisons in the locked garage. The Garage is off limits. Licensee understands that all poisons must be locked, not only inaccessible to children. Isolation area for sick children waiting to be picked up is in the dining room/ day care area. Per Licensee, there are no firearms or weapons stored in the home. There are no pools or spas, or other bodies of water.
Infant Care: Currently licensee does not care for infants under 12 months old. LPA advised if applicant decides to care for infants to sleep infants where they can be directly supervised at all times and advised against sleeping infants in a separate room. Applicant states that if enrolled, infants under 12 months will sleep in the living room in a play pen. Currently infants over 12 months sleep on a mat in the living room. LPA discussed the following with the Applicant: Cribs or play yard shall not hinder the entrance or exit from the sleeping space, mattresses shall be firm and covered with a fitted sheet that overlaps the underside so it cannot be dislodged. Infants shall not be swaddled while in care. LPA advised the Licensee that infants shall be placed on their backs for sleeping and shall be supervised. All infants shall be checked on every 15 minutes and the time of each 15-minute check shall be documented with child’s name and date. The LIC 9227 Individual Infant Sleeping Plan shall be completed for each infant up to 12 months of age. A copy of the LIC 9227 was provided to Applicant. LPA did not observe any children left in parked vehicles. Car seats shall only be used for transportation. LPA did not observe any children sleeping in car seats.
Overnight Care: There is no overnight care provided at the moment. LPA discussed the following: Licensee is aware that they must remain wake while children are awake. If children sleep in separate area from licensee, the door must remain open. If licensee cannot hear children when they wake up, video or audio device can be used.
Outdoor Area:
The outdoor play area was observed to be fenced. LPA observed that the outdoor yard has toys and other materials for children to play with. There is direct access to the second dwelling from the yard. LPA observed the sliding door to be locked. Per Licensee, children are supervised while playing outdoors.

Children’s records were reviewed for (LIC) 282- Affidavit Regarding Liability Insurance, Immunizations Records, LIC 700- Identification and Emergency Information, LIC 627- Consent for Medical Treatment, LIC 995A Notification of Parents’ Rights,
Staff records were reviewed for approved Pediatric First Aid and CPR certification, LIC-501: Personnel Record, LIC 508-Criminal Record Statement, LIC 9052- Employee Rights, Proof of immunization against measles, pertussis and influenza or influenza declination, TB clearance or risk assessment, LIC 9108- Statement of Child and Mandated Reporter Training Certificate. Licensee CPR/First Aid expire on 06/2023, Mandated Reporter certificates expires 3/16/2024.
During inspection all children were observed to be treated with dignity and respect, they were observed to be receiving safe, healthful and comfortable accommodations, furnishings and equipment, and free from corporal and/or unusual punishment.
LPA observed that licensee is implementing COVID-19 precautions and procedures.
Incidental Medical Services (IMS):
Incidental Medical Services (IMS) policy was discussed. For IMS information see Evaluator Manual – Regulation Interpretations and Procedures for Family Child Care Homes Section 102417. When any IMS is provided, a plan for providing IMS must be submitted to the Department. Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.
