Licensing Program Analyst (LPA) Ashley Calderon conducted an unannounced annual / random inspection at the above facility on 07/10/2025 at 1:34 PM. LPA met with Licensee Emmanuel Evans who allowed LPA entrance into the facility. LPA disclosed the purpose of today's visit. Licensee Evans notified Licensee Angel Christopher via telephonically of LPA Calderon's arrival. At 1:39pm LPA Calderon observed 14 day care children present. Three (3) children living in the home were present in the home and due to age over 10 years old do not count in the census. Upon arrival there were (3) adults present in the home. LPA was guided on a tour of off limit and on limit bedrooms and living room alongside E.Evans and at 1:49pm Licensee Angel Christopher arrived at the facility who continued the rest of the tour with LPA. Facility capacity is in compliance for a Large Family Child Care Home. Hours of operation are Mon-Sun 24 hours, provides overnight care when needed. At 1:49pm there were (4) adults present in the home, LPA reminded Licensee's temporary absent shall not exceed 20% of day care hours. Currently Per Licensee not caring for any infants. Per Licensee provides transpiration (if needed) and no pets currently are present in the home. This is a single story home which consists of three bedrooms and one bathroom. Areas used by the children include the living room (day-care room), bathroom, and side yard (fenced). Per Licensee, areas off limits to children and parents include: Three bedrooms (locked), front yard , back yard, and garage. Food is provided by Licensee. Licensee was reminded if children bring food from home it must be labeled with the child’s name and properly stored or refrigerated. Individuals residing in the home have been discussed and noted. All adults present in the home have obtained a criminal record clearance or exemption. All areas identified on the facility sketch that are accessible for children to use were inspected for safety, comfort, and cleanliness. FACILITY EVALUATION REPORT California law requires a public report of each licensing visit/inspection. This report is a record for the facility and the licensing agency. This report is available for public review; therefore, care is taken not to disclose personal or confidential information. Inquiries concerning the location, maintenance, and contents of these reports may be directed to the Licensing Program Analyst or Regional Office whose address and telephone number are listed on the front of this form.

DEFICIENCIES A deficiency is an instance of noncompliance with licensing requirements, including applicable statutes, regulations, interim licensing standards, operating standards, and written directives. Applicants/ licensees must be notified in writing of all licensing deficiencies. Deficiencies are listed on the left side of this form, and the applicable licensing requirement upon which the deficiency is identified. There are two types of deficiencies:
  • Type A deficiencies are violations of licensing requirements that, if not corrected, have a direct and immediate risk to the health, safety, or personal rights of persons in care.
  • Type B deficiencies are violations of licensing requirements that, without correction, could become a risk to the health, safety, or personal rights of persons in care, a recordkeeping violation that could impact the care of said persons and/or protection of their resources, or a violation that could impact those services required to meet the needs of persons in care.

PLANS OF CORRECTION (POCs) The licensing agency is required to establish a reasonable length of time to correct a deficiency. In order to set the time, the licensing agency must take into consideration the seriousness of the violation, the number of persons in care involved, and the availability of equipment and personnel necessary to correct the violation. Applicants/licensees are requested to provide a specific plan for each violation on the right side of the form across from each deficiency. The more specific the plan, the less chance exists for any misunderstanding in setting time limits and reviewing corrections. The applicant/licensee who encounters problems beyond their control in completing the corrections within the specified time frame may request and may be granted an extension of the correction due date by the licensing agency.

CORRECTION NOTIFICATION The applicant/licensee is responsible for completing all corrections and promptly notifying the licensing agency of corrections. Applicants/licensees are advised to keep a dated copy of any correspondence sent to the licensing agency concerning corrections, or if corrections are telephoned to the licensing agency, the date, person contacted, and information given.

CIVIL PENALTIES The licensing agency is required by law to issue a Penalty Notice, when applicable, to all facilities holding a license issued by the licensing agency, or subject to licensure, except Certified Family Homes, Resource Families, and Foster Family Homes, or any governmental entity.

PENALTY NOTICE GIVEN The statement concerning civil penalties serves as a penalty notice on this Licensing Report and failure to correct cited licensing deficiencies will result in civil penalties. Applicants/ licensees are required to pay civil penalties when administrative appeals have been exhausted and in accordance with any payment arrangements made with the licensing agency.

APPEAL RIGHTS The applicant/licensee has a right without prejudice to discuss any disagreement in this report with the licensing agency concerning the proper application of licensing requirements. The applicant/ licensee may request a formal review by the licensing agency to amend or dismiss the notice of deficiency and/ or civil penalty. Requests for review shall be made in writing within 15 business days of receipt of a deficiency notification or civil penalty assessment. Licensing deficiencies may be appealed pursuant to the procedures in the LIC 9058 Applicant/Licensee Rights.

AGENCY REVIEW The licensing agency review of an appeal may be conducted based upon information provided in writing by the applicant/licensee. The applicant/licensee may request an office meeting to provide additional information. The applicant/licensee will be notified in writing of the results of the agency review within 60 business days of the date when all necessary information has been provided to the licensing agency.

EMAIL REQUIREMENT Adult Community Care Facilities, Residential Care Facilities for the Chronically Ill, and Residential Care Facilities for the Elderly are required to provide and maintain an active email address of record with the licensing agency.

LPAs reviewed required posted documentation posted at the front door: LPA observed Facility License and Publication (PUB) 394- Notification of Parent Rights. LPA Calderon printed out LIC9148 Earthquake Preparedness Checklist and informed A.Christopher to post form. Facility records were reviewed for current LIC 9040- Facility Roster, form LIC9040 was not complete missing children's address , children's physician information, children's authorized representative information, enrollment date and date left, picture taken of roster, deficiency cited. . LIC 610- Facility Disaster Plan and Disaster drill log, last drill conducted on 6/30/2025. Facility holds Liability Insurance with Next Company- expires July 25, 2025.

Smoke and carbon monoxide detectors were tested and found operable. Fire extinguisher was observed, picture taken at 2:04pm, Licensee unable to provide receipt or service tag within the year, deficiency cited. The home maintains telephone service via cell phone and landline. The home is observed to be clean and orderly. There are toys and other age appropriate material available for children. Open wall face heater , in living room and in hallway observed screened only the bottom section, exposing the mid and upper section, picture taken at 2:02pm, deficiency cited. LPA observed at 1:59pm cleaning components , disinfecting products and laundry detergents accessible to children: Kirkland detergent pods , 2 disinfectants bottles, Oxy clean and Shout cleaning components on top of the laundry machine in the kitchen accessible to the children in care, picture taken and additionally there was a Oxy Clean yellow bottle on the changing table in the living room, deficiency cited. LPA observed locked cabinets in kitchen and bathroom for cleaning components, Licensee removed products and placed in locked cabinets. Licensee was reminded that all poisons must be lock, not only inaccessible to children.

Isolation area for sick children waiting to be picked up is in the kitchen, away from the other children. Per Licensee, there are fire arms in the home. LPA observed the fire arms and ammunition are stored in two separate lock boxes in an off limit area.

LPA observed a play yard visible in the living room per Licensee uses it for children ages 2 year old. LPA informed licensee child is comfortable and authorized representative are aware. Napping equipment does not block entrances or exits. Preschool / School age children use cots.

Children are using the side yard for outdoor play. The outdoor play area was observed to be fenced. There are no pools or spas, or other bodies of water. (Pg 2 / cont...)

Children’s records (6) were reviewed for (LIC) 282- Affidavit Regarding Liability Insurance (used for back up when Liability Insur. expires), Immunization Records (if applicable), LIC 700- Identification and Emergency Information, LIC 627- Consent for Medical Treatment, LIC 995A Notification of Parents’ Rights, and LIC9150 Additional Children in Care for Large FCC all were in children's files.

Staff records were reviewed: Pediatric First Aid and CPR certification for both Licensee's and staff assistant #1 expires July 14, 2025. Mandated Reporter Training Certificates for both Licensee's and staff assistant #1 expired and Staff #2 needs to obtain mandated reporter training, deficiency cited. Staff #1 and Staff #2 staff assistants are missing Immunization records: Measles and Pertussis (MMR / TDAP / DTAP), deficiency cited.

During inspection all children were observed to be treated with dignity and respect, they were observed to be receiving safe, healthful and comfortable accommodations, furnishings and equipment, and free from corporal and/or unusual punishment. Staff interview was conducted with Licensee.
  • Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

  • Licensee was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California.

LPA Calderon informed licensee Angel Christopher and Emmanuel Evans that this report dated 7/10/25 document(s) (1)Type A citation(s) which shall be posted for 30 consecutive days as there is/are immediate risk(s) to the health, safety, or personal rights of children in care.

Also, LPA Calderon informed the licensees to provide a copy of this licensing report dated 7/10/25 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

During the exit interview, the Licensee, confirmed that there are no Registered Sex Offenders living in the facility and LPA completed the RSO profile in FAS. Based on today’s visit, Per California Code of Regulations Title 22, the facility was given (1) deficiency, Type A and () Type B, provided on LIC 809-D.
