32 | In regards to allegation Licensee hits day care child- LPA conducted interviews with staff # 1- 2. All staff statements corroborated that they do not hit children in care and that they had children that would hit staff and other children in care. Licensee, disclosed that they talk to children at their level, offering them hugs and different activities for them to calm their body.
LPA conducted interviews with children. Children’s statements corroborated that they like attending the facility, that child # 1 has hit children and adults but that they have not been hit by any adults or witnessed any adults hitting any children.
LPA conducted interviews with parents and other adults associated with the facility. Statements corroborate that they do not have any concerns with the licensee or the care that the children received. Per adults they have observed Licensee, appropriately handle situations with children, talking to children at their level and offering different solutions to better support the children. Additionally, LPA obtained parent evaluations regarding the facility and provider that were given during parent conferences. Evaluations disclosed that they their children have learned a lot attending the facility and that they do not have any concerns with the care their children received.
This agency has investigated the complaint alleging Licensee hit day care child in care. Based upon the evidence as presented above, the allegation has been determined to be Unsubstantiated. A finding of Unsubstantiated means that although the allegation may have happened or is valid, there is not a preponderance of evidence to prove alleged violation(s) did or did not occur, therefore at this time the above allegation is unsubstantiated.
At this time, the licensee is in compliance with California Code of Regulations Title 22. No deficiencies cited.
