Complaint inspection conducted by Licensing Program Analyst (LPA) Jennifer Hua. LPA was let in facility by licensee, Celina Heredia. A Covid-19 risk assessment was conducted. Purpose of the visit was announced. A tour of facility was conducted with licensee, census was taken. Upon arrival, LPA observed 6 children in care supervised by licensee and licensee's husband Manuel Heredia. Allegations reviewed with licensee.

It was alleged that an infant ingested a piece of oleander fruit and day care facility did not call 911.

Interview conducted with licensee. Per licensee, on the day in question, at around 12:10pm, while the children were playing outside, an infant ingested the oleander fruit. Licensee was outside with 3 children at the time. Licensee did not seek medical attention even after finding out that the fruit infant ingested is poisonous.

This agency has investigated the complaint alleging licensee did not provide adequate supervision to a day care child and licensee did not seek timely medical attention for a day care child. Based on LPA's interview which was conducted, the preponderance of evidence standard has been met, therefore the above allegations are found to be substantiated. California Code of Regulations, Title 22 are being cited on the attached LIC 9099D.

Upon receipt of this report documenting a substantiated complaint allegation and a Type A deficiency, the licensee shall do the following:
1. Post the Notice of Site visit and any licensing report documenting a Type “A” deficiency.
2. The report and the Notice of Site visit shall be posted for 30 consecutive days. Failure to maintain posting as required, will result in an immediate $100 civil penalty.
3. A copy of this report shall be provided to the parent/guardian of children currently enrolled by the next business day or immediately upon return. A copy of this report shall also be provided to the parent/guardian of any newly enrolled children for the next 12 months (1 year).
4. The Acknowledgement form (LIC 9224) must be maintained in each child’s file immediately upon receipt from parent. A copy of the parent Acknowledgement of Receipt of Licensing Reports Form was provided during this visit.

Exit interview was conducted with Celina Heredia, licensee, including, but not limited to Provider Rights, Appeal Procedures and Agencies Consultative Role. .

Operation of a Family Child Care Home. The licensee shall be present in the home and shall ensure that children in care are supervised at all times.... The requirement is not met as evidenced by: Licensee confirmed that an infant ingested the oleander fruit while playing outside. This poses an immediate health and safety risk of children in care.

Per licensee, has a put a gate by area where the the tree is at, has put a chair by the area where a staff will sit to ensure children do not go to the area. Will do a sweep prior to children going outside. Licensee will subnit a written statement to Licensing by the POC due date.

Personal Rights. Each child receiving services from a family child care home shall have certain rights that shall not be waived or abridged by the licensee regardless of consent or authorization from the child's authorized representative. These rights include, but are not limited to, the following:

Per licensee, has trim some of the tree branches that hangs over the property. Licensee will have all the branches that hang over completely trim as soon as possible. Licensee is also working with the neighbor to get the tree removed. Licensee will update LPA and send photos of correction once completed.

To receive safe, healthful, and comfortable accommodations, furnishings, and equipment. The requirement is not met as evidenced by. Licensee did not seek medical attention after finding out the infant ingested a poisonous fruit. This poses an immediate health and safety risk of children in care.
