Licensing Program Analysts (LPA) Cynthia Reyes conducted an unannounced site inspection to complete the investigation and present the findings of the above complaint allegations. This inspection is to ensure the health and safety standards as required by the regulations governing child care centers are met. LPA met with Yesenia Arteaga, Program Manager and census of children (28) and teachers (11) were taken.

During the course of this investigation, LPA conducted Interviews, observation and received and reviewed documents.

Physical Plant- Staff does not ensure playground is free of animal feces. Reporting Party (Rp) stated that child #1 had cat feces on his pants and another time on his shoes. Also child #1 got a scratch on his fore head from a low hanging branch from a tree in his play ground. Per interviews with staff and photos obtained
the facility has been working on the play ground and has removed some of the wood chips already and been replacing them with rubber turf to prevent the neighborhood cats from using the play yard.

During the course of this investigation, LPA conducted Interviews, observation and received and reviewed documents.

Neglect/Lack of Supervision- Reporting Party (Rp) stated Staff does not provide adequate supervision resulting in day care child sustaining multiple injuries. Rp stated over the past several months, child #1 has sustained multiple injuries, Most concerning is that the majority of these injuries have involved the child's head. Per interviews and documents received the staff did observe and documented all the injury's the child had which were all accidents. Per Interviews mom was notified of all incidents and how they happened.

Facility has kept mom informed of anything to do with her child (Emails provided to the LPA). There were no disclosures of lack of care and supervision by any staff. LPA observed the child as he is still in care and is a typical two year old who is active, runs and plays with friends and is very curious. Rp stated the child is pigeon toed and does not have any other feet issues, however interviews stated the child does trip over his own feet but that is a typical child.

Although the allegation may have happened or is valid there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegation is Unsubstantiated.

The Notice of Site Visit (LIC 9213) – must remain posted for 30 days during the hours of operation after each site visit by a licensing representative. Failure to maintain posting as required will result in a civil penalty of $100.00. Appeal rights were provided.

The facility has also been monitoring the play yard daily every morning before the children use the yard.

Reporting Party (Rp) also stated child #1 received a visible slash across his forehead from a low-hanging tree branch in the child's play yard. LPA observed and obtained photos of the tree before and after and observed the slash to be small that did not cause bleeding or any major injury to the child. The facility pinned up the tree and cut the low hanging branches a few days after it was brought to there attention and informed the parent that the trees in the play yards will be monitored closely to be trimmed when needed.

Based on LPA observations and interviews which were conducted and records received and reviewed, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. California Code of Regulations, Title 22, Division 12 & Chapter 1, are being cited on the attached LIC 9099D page. Deficiencies that are being cited need to be cleared to protect the children’s health & safe.

A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100

Per Program Manager they have already taken steps to prevent other incidents to happen regarding the cat feces and the low tree branches. Program manager will document the steps (check list/log) with how they are monitoring the yard for all issues on a daily and submit to LPA by the POC date

that pose a fire hazard. This requirement is not met as evidenced by: Interviews & photos, tree branches were low and child was scratched and cat feces observed in the outdoor play yard and the child had cat feces on clothes and shoes. This poses a potential health and safety risk to children in care.
