At 1:00 pm Licensing Program Analysts (LPAs) Lilli Babcock and Monica Ruiz conducted an unannounced annual inspection to the above facility. A COVID risk assessment was conducted. LPAs met with Licensee, Nora Lopez, to whom the reason for the visit was explained. Form LIC 126 was provided. Per Licensee, there are 10 children currently enrolled. There were 7 children, including one school-age child, present upon arrival. Assistant arrived to the facility at approximately 1:10 pm. The licensee was observed to be operating within the license capacity limitations.

The licensee states that 3 adults and no children currently live in the home. Per Licensee, there is one assistant in the facility.

This is a one-story home which consists of 2 bedrooms, 2 bathrooms, living room, dining room, kitchen, kids’ room “used for daycare”, detached garage, front yard, and backyard which is fenced.

Per licensee, areas off limits to children and parents include 2 bedrooms, 1 bathroom, kitchen, detached garage, and front yard. The children have access to dining room, living room, kids’ room, one bathroom, and backyard which is fenced.

Licensee guided analysts on a tour of the facility at 1:10 pm after assistant arrived to assist with children in care during the tour. During this visit, all areas identified on the facility sketch that are accessible for children to use were toured and inspected and the following was observed.

FACILITY EVALUATION REPORT California law requires a public report of each licensing visit/inspection. This report is a record for the facility and the licensing agency. This report is available for public review; therefore, care is taken not to disclose personal or confidential information. Inquiries concerning the location, maintenance, and contents of these reports may be directed to the Licensing Program Analyst or Regional Office whose address and telephone number are listed on the front of this form.

DEFICIENCIES A deficiency is an instance of noncompliance with licensing requirements, including applicable statutes, regulations, interim licensing standards, operating standards, and written directives. Applicants/ licensees must be notified in writing of all licensing deficiencies. Deficiencies are listed on the left side of this form, and the applicable licensing requirement upon which the deficiency is identified. There are two types of deficiencies:
  • Type A deficiencies are violations of licensing requirements that, if not corrected, have a direct and immediate risk to the health, safety, or personal rights of persons in care.
  • Type B deficiencies are violations of licensing requirements that, without correction, could become a risk to the health, safety, or personal rights of persons in care, a recordkeeping violation that could impact the care of said persons and/or protection of their resources, or a violation that could impact those services required to meet the needs of persons in care.

PLANS OF CORRECTION (POCs) The licensing agency is required to establish a reasonable length of time to correct a deficiency. In order to set the time, the licensing agency must take into consideration the seriousness of the violation, the number of persons in care involved, and the availability of equipment and personnel necessary to correct the violation. Applicants/licensees are requested to provide a specific plan for each violation on the right side of the form across from each deficiency. The more specific the plan, the less chance exists for any misunderstanding in setting time limits and reviewing corrections. The applicant/licensee who encounters problems beyond their control in completing the corrections within the specified time frame may request and may be granted an extension of the correction due date by the licensing agency.

CORRECTION NOTIFICATION The applicant/licensee is responsible for completing all corrections and promptly notifying the licensing agency of corrections. Applicants/licensees are advised to keep a dated copy of any correspondence sent to the licensing agency concerning corrections, or if corrections are telephoned to the licensing agency, the date, person contacted, and information given.

CIVIL PENALTIES The licensing agency is required by law to issue a Penalty Notice, when applicable, to all facilities holding a license issued by the licensing agency, or subject to licensure, except Certified Family Homes, Resource Families, and Foster Family Homes, or any governmental entity.

PENALTY NOTICE GIVEN The statement concerning civil penalties serves as a penalty notice on this Licensing Report and failure to correct cited licensing deficiencies will result in civil penalties. Applicants/ licensees are required to pay civil penalties when administrative appeals have been exhausted and in accordance with any payment arrangements made with the licensing agency.

APPEAL RIGHTS The applicant/licensee has a right without prejudice to discuss any disagreement in this report with the licensing agency concerning the proper application of licensing requirements. The applicant/ licensee may request a formal review by the licensing agency to amend or dismiss the notice of deficiency and/ or civil penalty. Requests for review shall be made in writing within 15 business days of receipt of a deficiency notification or civil penalty assessment. Licensing deficiencies may be appealed pursuant to the procedures in the LIC 9058 Applicant/Licensee Rights.

AGENCY REVIEW The licensing agency review of an appeal may be conducted based upon information provided in writing by the applicant/licensee. The applicant/licensee may request an office meeting to provide additional information. The applicant/licensee will be notified in writing of the results of the agency review within 60 business days of the date when all necessary information has been provided to the licensing agency.

EMAIL REQUIREMENT Adult Community Care Facilities, Residential Care Facilities for the Chronically Ill, and Residential Care Facilities for the Elderly are required to provide and maintain an active email address of record with the licensing agency.

Smoking is prohibited in a licensed Family Child Care Home. Per Licensee, no one smokes in the home.

LPAs did not observe the following items during the inspection: Infant Walkers, Johnny Jumpers, Saucer Chairs, and/or any other item that fall into these categories are not permitted in a family child care facility.

LPAs also informed licensee Nora Lopez of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

Incidental Medical Services (IMS) policy was discussed. For IMS information see Evaluator Manual - Regulation Interpretations and Procedures for Child Care Centers Sections 101173 and 101226. When any IMS is provided, an updated Plan of Operation that includes IMS must be submitted to the Department. Facility License, Emergency Disaster Plan, Parent’s Rights Poster, and Earthquake Preparedness Checklist were observed to be posted in the entry way of the home. A current children’s roster was available for review.

There is telephone service via a land line in the home. Hours of operation are Monday – Friday, 6:00 am – 8:00 pm. There is ventilation and central heating in the home. LPAs observed a wood burning fireplace in the living room that is screened and locked making it inaccessible to children.

Detergents, cleaning compounds, and medications were observed to be inaccessible to children. Licensee states there are no poisons on the premises. LPAs advised that any poisons should be locked under key or combination lock. Licensee states that there are no firearms or weapons stored in the home.

The valve on the required 2A 10BC fire extinguisher indicates fully charged, and was purchases on 1/25/25 as indicated on the purchase receipt. Smoke and carbon monoxide detectors were tested and are operable at this time.

All homes shall conduct fire and disaster drills at least once every six months and document the date and time of each drill. Last drill documented was conducted on 2/20/25.

The home is observed to be clean and orderly. There are first aid supplies available. There are age-appropriate toys available for children such as blocks, action figures, and sensory toys. Appropriate sleeping arrangements in form of mats and playpens were observed.

Licensee states that the living room is used as an isolation area for sick children to rest until their parent arrives.

Licensee states that she is currently caring for one infant. LPAs observed an Individualized Sleeping Plan for the infant in care. Licensee does not have proof of a complete documented sleep log for the infant. LPAs consulted with Licensee regarding Safe Sleep regulations.

Currently, children are using the back yard for outdoor play time. The outdoor play area was observed to be fenced. LPA observed that the outdoor yard has toys and other materials for children to play with such as tricycles, riding cars and basketball hoops. LPAs observed an air-conditional exhaust in the backyard and recommended making the air conditioning unit inaccessible to children in care due to the fan blades on the top of the unit. No bodies of water were observed on this day.

At 1:45 pm children’s records were reviewed, including emergency information, and were observed to be complete.

At 2:00pm Licensee and staff records were reviewed. LPAs observed that Licensee has proof of Pediatric First Aid/CPR with an expiration date of 7/17/2026. Mandated Reporter AB 1207 compliant training certificate for Licensee is not current and expired on 7/17/24. Licensee does not have proof of Preventative Health and Safety Training from an EMSA training company.


LPA observed Staff #2 has Pediatric First Aid and CPR with American Heart Association which expires on 2/1/27. Mandated Reporter AB 1207 compliant training certificate for Staff #2 expires on 1/14/27.

LPA issued an LIC 857, Children’s Record Review, and LIC 859, Staff Record Review to the licensee which documents staff and children’s files reviewed during this inspection.

Per licensee there are no pets on the premises.

Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

LPAs discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

Based on the LPAs observations and records review, the following deficiencies listed on the attached LIC 809D (deficiency page) are being cited in accordance with California Code of Regulations Title 22. Deficiencies that are being cited need to be cleared to protect the children’s health and safety.
