Licensing Program Analyst (LPA) Saul Valenzuela conducted a Case Management Deficiencies visit on this date to address deficiencies revealed on 11/21/2024 during an inspection. Census was taken.

During the inspection that was conducted on 11/21/2024, it was revealed by Staff #3 that they observed Child #1 unsupervised on 11/19/2024 and Child #2 unsupervised on 11/21/2024. According to Staff #3, on 11/19/2024 they observed Child #1 alone standing outside of the classroom with the door shut that leads into the classroom. Per Staff #3 they were unsure for how long the child was standing outside of the class with the door shut. Staff #3 brought Child #1 back into the classroom, and notified Staff #1 and Staff #2 that Child #1 was outside alone. According to Staff #3, Staff #1 and #2 "shrugged" their shoulders and did not respond to Staff #3. Per Staff #3, they attempted to call the Monterey Park Regional Office but were unable to speak to anyone as the call was disconnected. LPA conducted interview with Child #1, Child #1 stated they remember being alone outside of the classroom.

During the inspection on 11/21/2024 at 3:25 p.m., LPA was approached by Staff #3 that they observed Child #2 alone at 3:17 p.m. on the outside porch that leads into the classroom. Per Staff #3, they asked Child #2 if any teachers were aware that they were outside by themselves, according to Staff #3, Child #2 responded "no". Staff #3 stated that Director walked out to the porch, and that Staff #3 notified the Director that Child #2 was alone outside. Per Staff #3, Director did not respond to Staff #3. During interviews, Director stated that they did not respond to Staff #3 "because I am not interested in argue in front of the children". LPA was unable to conduct interview with Child #2 at the time of the inspection.

During the facility tour on 11/22/2024, at 8:50 a.m. LPA observed 4 children unsupervised in the front yard near the porch for approximately 30 seconds, until staff #1 appeared around the corner and stood at the corner of the front yard to observe the entire yard. At 8:56 a.m., LPA observed 3 children playing unsupervised near the front entrance. Director was observed by LPA to be speaking with parents on the other side of the fence near the 3 children which obscures visual observation of the children. LPA observed Staff #4 tending to another child with their back turned to the three children that were unsupervised, and Staff #1 was observed to be around the corner supervising children near the porch area.

Based on LPA observations, the following deficiencies listed on the attached LIC 809D (deficiency page) are being cited in accordance with California Code of Regulations Title 22. Deficiencies that are being cited need to be cleared to protect the children’s health and safety.

LPA Saul Valenzuela informed Director Mali Rand that this report dated 11/22/2024 document(s) 1 Type A citation which shall be posted for 30 consecutive days as there is/are immediate risk(s) to the health, safety, or personal rights of children in care.

Also, LPA Saul Valenzuela informed the Director to provide a copy of this licensing report dated 11/22/2024 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

Director stated that they will create a plan and have a meeting with staff to ensure that children are being supervised. Director will watch CCLD videos on supervision and submit a written report on how the facility will ensure children are being supervised.
