Licensing Program Analyst (LPA) Nolan Tcheng conducted an unannounced initial inspection of a complaint investigation. Upon arrival at 8:50am, LPA met with Area Manager Anthony Davis, to whom the purpsoe of the inspection was explained. A tour of the faiclity was provided. There were children present during time of inspection.

Census was taken. There were 24 children with 4 staff members.

During todays inspection, LPA conducted interviews with four staff members. Documentation in the form of staff schedules and Children Check In/Outs were obtained.

Information from the complainant indicates that staff are not ensuring that teacher-child ratios are maintained at the facilities.

During interviews, there were disclosures from staff regarding the teacher-child ratio at the facility. It was disclosed that staff are out of ratio by 2 or 3 children in the morning, prior to staff clocking in. It was also disclosed by multiple staff that they have had 13 children in their class at one time, with just a behavioral aide/therapist present with them in the room. LPA discussed with Area Manager that behavioral aides/therapists are not allowed to be considered part of ratio nor used to nullify the presence of one child in the class ratio.

Based on LPA interviews that were conducted, the preponderance of evidence standard has been met, therefore the above allegation(s) is found to be SUBSTANTIATED. California Code of Regulations, (Title 22, Division 12 Chapter 1 101216.3 Teacher-Child Ratio), are being cited on the attached deficiencies page.

On 02/26/2025, the facility was cited for the same deficiency. This repeat violation will result in an immediate $250 civil penalty is being assessed to the facility.

LPA Tcheng informed Area Manager that this report dated 03/12/2025 documents one Type A citation, which shall be posted for 30 consecutive days as there is immediate risk to the health, safety, and personal rights of children in care.

Also, LPA Tcheng informed the Area Manager to provide a copy of this licensing report dated 03/12/2025, that documents any Type A citation, to parent/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC9224), or other written statement, must be placed in the child's file for verification.

A notice of site visit was given and must remain posted for 30 days.

Exit interview conducted and report was reviewed with Area Manager Anthony Davis, at 12:20pm. Plan of corrections developed and Copy of Report provided.

Per Area Manager, they are hiring new staff and will send proof of start date. They will schedule staff in a manner that will ensure that there are adequate staff present at all times. Staff schedule will be sent to LPA by POC date

Based on interview and record review, licensee did not ensure that there were adequate staff to satisfy the teacher-child ratio of 1:12. This posed an immediate risk to the health, safety, and personal rights of children in care.
