32 | The complaint alleges the licensee is at the home in the morning but leaves the home throughout the day and licensee is never there when reporting party comes at random times to pick up their child. During interviews, Parent #1 (P1) stated they don’t usually come in the door and are usually “greeted by the assistant and licensee may have been there and P1 just didn’t see her”. Parent #3 (P3) stated licensee “is picking up kids sometimes”, and Parent #2, #4, #5, and #6 stated yes when asked if the Licensee is generally at home when they drop off and pick up their children. Licensee stated she only leaves the facility to pick up children from school when needed or go to the market. Assistant stated the Licensee is only gone for 10 minutes when she leaves the facility. During licensing visits on 8/29/24, 9/5/24, and 9/27/24, the licensee was at the facility upon arrival by LPA, with the exception of the visit on 8/29/24 when the licensee was picking children up from school and was observed to arrive approximately 10 minutes after LPA arrived at the facility.
Allegation: Children sit in highchairs all day
Complaint alleges the children in care sit in highchairs all day. During interviews conducted the Licensee stated the children are only placed in highchairs during mealtimes. Licensee’s Assistant stated the children have never been placed in highchairs all day. Parents interviewed stated they have only observed children in highchairs during mealtimes.
This agency has investigated the complaints alleging children sit in highchairs all day and the licensee is absent from the facility for more than 20% of the hours of operation. Based upon the evidence as presented above, the allegations have been determined to be Unsubstantiated. A finding of Unsubstantiated means that although the allegations may have happened or are valid, there is not a preponderance of evidence to prove alleged violations did or did not occur, therefore at this time the above allegations are unsubstantiated.
There were no deficiencies cited on the above-mentioned allegations per California Code of Regulations Title 22.
A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
