Licensing Program Analyst (LPA) Jennifer Hua conducted an unannounced complaint inspection at the above facility. A COVID-19 risk assessment was conducted. The purpose of the inspection is to deliver the finding regarding the above allegation. LPA met with Lei Zhang, Licensee. LPA observed 9 children in care supervised by Licensee and assistant Lili Wang.

The investigation was conducted by the Department’s Investigation Bureau by Investigator Laura Garcia. The investigation consisted of interviews that were conducted with licensee, the child’s parents, daycare staff, daycare parents, Reporting Party (RP), and other relevant parties. Records were also reviewed including Children’s Hospital documentation, police reports and Forensic Medical Reports.

The complaint alleges the infant sustained a fracture to the leg while in care.

According to licensee, the day of the incident, child was dropped off at approximately 8:45am by father and licensee observed the child was crying prior to drop off. However, the licensee was aware that the child usually displays separation anxieties during drop off times. The licensee denied any type of incident or fall occurring to the child while the child was in care. The licensee also stated that the child was fussier than normal and less mobile, however, there were no other unusual signs. The licensee’s mother was interviewed by investigator Garcia. The mother assists with the day care, stating that her duties consist of helping with the children and their needs and making sure they are safe. She denied noticing anything unusual and stated that the child was acting normal. It was stated that the child napped well throughout the day and did not observe any kind of incident or the child crying in pain or in hysteria, adding that children are supervised.

IB Investigator also interviewed licensee’s school-age child. According to licensee’s child, she usually plays with the day care children and makes sure that children do not hit each other. The licensee’s child denied the day care child got hurt or that someone hurt the child. According to other day care staff, their duties consist of assisting licensee with the supervision of the children and keeping them safe, but their primary duty is cooking. Staff denied ever noticing the child getting hurt or any other accidents at the day care.

According to the child’s mother, she did not have any previous complaints about the facility. She indicated that her husband dropped the child off at the day care around 8:30am. The child was active and happy prior to getting dropped off. Her husband picked up the child from day care and noticed the child was fussier and clingy. It was observed that child was favoring the right leg and that child had a bruise on the arm.

According to the child’s father, the child was acting normal, he dropped the child off at day care around 8:30am. He went back to the day care around 4:45pm and noticed that the child was acting as if she was not feeling well. He described the child as being a bit more “fussier and clingier” than normal but denied that the child was in any type of excruciating pain. The following day, the child was taken to the Emergency Room.

According to the LA County Child Abuse Pediatrician, Forensics results revealed that the child sustained a femur fracture to the right leg. However, the attending Pediatrician was unable to determine where the child sustained the injury. Also, the Los Angeles Police and the Alhambra Police Department assisted with the investigation, but both were unable to determine where the injury occurred as well. According to day care parents interviewed, they have never witnessed any type of neglect/lack of care by facility staff. The children are always happy and there have never been any issues or concerns.

Based on the above, although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is unsubstantiated.

An exit interview conducted with Licensee, Lei Zhang, copy of report provided and Notice of Site Visit provided and shall be posted for 30 days in an area accessible for review.
