On 2/28/2025 at 10:10 am, Licensing Program Analysts (LPAs) Monica Ruiz and Roxana Lopez conducted an Unannounced Required – 3 Year inspection to the above facility. Upon arrival, LPA disclosed the purpose of the inspection and met with Licensee, who let us in to the home. Licensee’s Assistant (Spouse) Edgar Pulley guided LPAs on a tour of the facility, while licensee cared for children. Licensee is Spanish-speaking so Licensee’s spouse/assistant states he will translate this inspection for Licensee. There were nine (9) children present during today’s inspection, three of who are infants. Licensee states that there are currently twenty-two (22) children enrolled. The children's roster was reviewed and is current. Per licensee, the facility’s hours of operation are 6:00am-6pm. Adults in the home were discussed and all have criminal record clearance. Also present at time of inspection was licensee’s daughter, age 15.

At 10:25am LPAs observed child # 1 in the off-limit kitchen area- Cleaning compounds were observed in an unlocked cabinet and on the floor Assistant Edgar brought child out of the kitchen. LPAs observed that child # 1 is also able to open the door leading to the garage. LPAs advised that both the gate leading to the kitchen and the garage door need to be inaccessible for children. Licensee, added locks to kitchen cabinet and garage door during inspection

Emergency Disaster Plan, License, and Parents’ Rights were posted at the time of inspection. Disaster drill log was also available during today’s inspection, last disaster drill conducted on 2/17/25.

LPA discussed the safe sleep regulations with licensee and facility representative and discussed the Child Care Licensing Safe Sleep web page at: https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee and facility representative of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

LPAs advised Licensee that Safe Sleep is documented every 15 minutes for each child in care, until the age of two.

Incidental Medical Services (IMS) policy was discussed. For IMS information see

PIN 22-02-CCP. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. Licensee and facility representative was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California.

During the exit interview, the Licensee Alba Nidia Giraldo, confirmed that there are no Registered Sex Offenders living in the facility and LPA completed the RSO profile in FAS.

Beginning on January 1, 2018, this law requires all licensed providers, applicants, directors and employees to complete training as specified on their mandated reporter duties and to renew their training every two years. LPA observed one large breed dog behind a latched gate in off-limits area of backyard at time of inspection.

Per Licensee, there are no weapons or firearms in the home and there are no bodies of water on the premises. Per LPAs observations, there are no bodies of water on the premises and there are no firearms/weapons on the premises at time of inspection.

The valve on the required 2A 10BC fire extinguisher indicates fully charged and was last inspected on 12/04/24. Smoke and carbon monoxide detectors are in operable condition. Per Licensee, First Aid kit is kept in the, LPA observed First Aid kit and was inventoried for necessary supplies. The Licensee has current Pediatric First Aid and CPR. Proof of immunization against influenza, pertussis, and measles was readily available during today’s inspection. The Licensee has also taken the Mandated Reporter Training.

—Children records and required licensing forms were discussed as well as mandated child abuse reporting and criminal record clearance requirement.

The following were discussed:
Rooms that are off-limits need to be made inaccessible during operating hours. NO smoking, NO infant walkers, NO Johnny jumpers, NO saucer chairs, NO incline sleepers and any other item that falls into that category are permitted in the facility. Effective January 1, 2010, licensees of family child care homes are required to ensure that at least one staff member with current training in pediatric first aid and pediatric CPR is on site at all times when children are present.

This is a small family home which consists of 3 bedrooms and 2 bathrooms, kitchen, dining room and living room, den, and attached garage. There is a fireplace in the home that is barricaded and inoperable. Areas used by the children include the living room, one restroom, and patio. Per Licensee, areas off limits to children and parents include kitchen, laundry and three bedrooms and garage. LPAs observed that there are baby gates separating areas used by children and off-limits areas but are easily opened by children in care. Per licensee, off limit areas are also locked during operating hours, LPAs observed doors to be unlocked. LPAs recommended to lock all doors to off-limit areas.

All areas identified on the facility sketch as accessible to children were inspected to ensure that they are clean and orderly with ventilation and heating for the safety of the children. There is a working telephone maintained in the home. LPA observed age-appropriate toys, free of loose and sharp parts. LPA observed electrical cover outlets all through the home. The Licensee states that there are no poisons in the home. The Licensee does understand that poison must be locked. The Licensee was advised that inaccessibility of hazards must be constantly reassessed depending on the children in care. Personal Rights of children were observed by LPA at time of inspection.

Per licensee, the children will have access to backyard area. LPA observed backyard has grass and adequate perimeter fencing through-out the yard. LPA observed age-appropriate toys such as a play houses, doll house, play kitchen, blocks, and books, all free of loose and sharp parts available for the children in the backyard. and all trees, shrubs, and plants are maintained.

Per licensee, they provide food for children in care.

Licensee and Assistant/Spouse state they use physical distance to keep children who are sick away from other children in care, until their parents can pick them up.

Senate Bill 792: this bill, commencing September 1, 2016, prohibits a person from being employed or volunteering at a child care facility or family day care if he or she has not been immunized against influenza, pertussis and measles. LPA discussed the influenza waiver during the visit. LPA reviewed and issued the LIC 311D - Forms/Records to Keep in Your Family Child Care Home. Mandatory Forms for the children’s files and staff files, requirements for fire drills, earthquake drills and documentation were discussed. Role and responsibilities of being a Mandated Reporter were reviewed. The Licensee was advised how to access forms and Regulations online at www.ccld.ca.gov. Licensee was made aware that it is his/her responsibility to know the regulations as well as anyone who assists in providing care.

Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

Based on the LPAs observations and record reviews, the following deficiencies listed on the attached LIC 809D (deficiency page) are being cited in accordance with California Code of Regulations Title 22. Deficiencies that are being cited need to be cleared to protect the children’s health and safety
