32 | LPA conducted interviews with Director, parents and staff and obtained consistent statements that parents have entered the facility beyond the parking lot/main gate on a few occasions but rarely into the classrooms. However, Per Director’s own admission she was unaware of any updates or changes to visiting guidelines initially issued by DPH. Additionally, during LPA’s initial visit on 9/26/22 to address a related complaint, LPA Baluyot clarified the policy regarding Parents’ Rights to enter the facility and issued a Technical Advisory on that day. It was explained to Director Peralta that this was a precautionary measure initiated by DPH at the beginning of the pandemic (and) has never had any legal/or licensing regulation basis or support. Director was also advised to change the wording on their Covid Policy and Procedures to reflect the/their guideline accurately. Changes in facility’s written/posted are still currently pending, however Director states, that if made, requests to visit inside a classroom facility will make every attempt to accommodate with children's safety and other parents rights taken into consideration.
Based on consistent statements obtained from interviews, this agency has investigated the complaint alleging “Parents are not allowed inside the facility.” and determined the allegation to be UNSUBSTANTIATED. A finding of UNSUBSTANTIATED means that although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur.
An exit interview was conducted with Director, Maribeth Peralta at 12:40 pm, and a copy of this report was provided and signed by LPA Bardo Baluyot. There are no deficiencies cited on today’s inspection. The notice of site visit must be posted where the parent/guardian of children enter and exit the facility. This notice shall remain posted for 30 consecutive days. Failure to maintain posting as required will result in a $100.00 civil penalty.
